WEBVTT

00:00.000 --> 00:03.880
Our of six o'clock having arrived on this 21st of July, 2026.

00:03.880 --> 00:07.520
It is my honor to call to order the City of Racine Common

00:07.520 --> 00:08.680
Council.

00:08.680 --> 00:10.920
First part of our business is to ask all of you to rise

00:10.920 --> 00:12.880
as you are able and join me in the Pledge of Allegiance

00:12.880 --> 00:15.360
to the flag.

00:15.360 --> 00:19.960
I pledge allegiance to the flag of the United States of America

00:19.960 --> 00:24.880
and to the republic for which it stands, one nation under God,

00:24.880 --> 00:27.520
indivisible, with liberty and justice for all.

00:37.120 --> 00:38.720
I will not ask the council president

00:38.720 --> 00:40.480
if there are any absences, since everyone

00:40.480 --> 00:42.200
is in attendance this evening.

00:42.200 --> 00:44.200
But I will ask the council president,

00:44.200 --> 00:47.520
if he would like to make a motion to approve the minutes

00:47.520 --> 00:51.240
or record proceedings for July 7, 2026.

00:51.240 --> 00:52.600
I move to approve.

00:52.680 --> 00:53.720
Motion to approve.

00:53.720 --> 00:55.160
Multiple seconds.

00:55.160 --> 00:57.400
Any discussion on said minutes?

00:57.400 --> 01:00.000
Seeing none, all those in favor, please say aye.

01:00.000 --> 01:01.000
Aye.

01:01.000 --> 01:02.000
Opposed.

01:02.000 --> 01:03.720
That motion carries.

01:03.720 --> 01:05.960
We do have Alder Kelley joining us remotely tonight,

01:05.960 --> 01:07.240
so just procedure of that means we

01:07.240 --> 01:10.240
will be doing verbal roll call votes this evening.

01:10.240 --> 01:11.600
We'll move on to proclamation.

01:11.600 --> 01:14.000
We do have one proclamation this evening,

01:14.000 --> 01:16.760
which is anticipation of National Night Out.

01:16.760 --> 01:18.680
Just from a scheduling reminder,

01:18.680 --> 01:22.040
reminder everyone, we are meeting on August 5th,

01:22.880 --> 01:27.040
the first week of August, because National Night Out

01:27.040 --> 01:28.800
is on Tuesday, August 4th.

01:28.800 --> 01:29.960
So we usually meet on Tuesdays.

01:29.960 --> 01:32.960
Obviously, that particular week, we will be meeting on Wednesday.

01:32.960 --> 01:36.200
And we have a proclamation here in anticipation of this.

01:36.200 --> 01:42.160
And it reads, whereas, proclamation 5219,

01:42.160 --> 01:43.560
issued by President Ronald Reagan,

01:43.560 --> 01:49.200
pursuant to Senate Joint Resolution 298 in July 1984,

01:49.200 --> 01:56.280
declared, oh, I'm sorry, this is the wrong item on the agenda.

01:56.280 --> 01:58.440
I apologize, this is the wrong proclamation.

01:58.440 --> 02:00.200
We will read the National Night Proclamation

02:00.200 --> 02:03.320
at the actual event on August 4th.

02:03.320 --> 02:05.400
Let's move on then to public comments.

02:12.760 --> 02:15.400
The public comment segment is opportunity for citizens

02:15.400 --> 02:17.520
to speak directly to the comment section.

02:17.520 --> 02:20.320
Speakers will limit their remarks to three minutes.

02:20.320 --> 02:22.480
There shall be no dialogue or interaction

02:22.480 --> 02:25.680
between the speaker and elected officials or staff.

02:25.680 --> 02:29.080
This time is not intended to be a debate or discussion.

02:29.080 --> 02:31.680
The Common Council shall not hear personal complaints

02:31.680 --> 02:35.000
or attacks against any city, employee, or elected official

02:35.000 --> 02:37.560
or any matter related to individual claim,

02:37.560 --> 02:41.120
citation, appeal, or lawsuit, profane, destructive,

02:41.120 --> 02:44.160
threatening, or conduct that otherwise impelate

02:44.200 --> 02:47.400
and pizza safety, or effective conduct

02:47.400 --> 02:49.960
of the Common Council meeting is equally unacceptable

02:49.960 --> 02:51.760
during the public comment period,

02:51.760 --> 02:54.640
as it is during all other portions of city meetings.

02:54.640 --> 02:57.920
Candidates for public office may not use this opportunity

02:57.920 --> 02:59.480
to campaign for office.

02:59.480 --> 03:03.160
Speakers during the public comment period shall follow all the rules

03:03.160 --> 03:06.560
of the comment council in rulings of the chair,

03:06.560 --> 03:09.760
including decisions to terminate the remarks

03:09.760 --> 03:12.200
if the speaker does not adhere to these rules.

03:12.240 --> 03:14.760
Public comments shall be limited to ideals or concerns

03:14.760 --> 03:16.480
regarding the city we're seeing.

03:16.480 --> 03:18.600
We encourage you to submit any detailed concerns

03:18.600 --> 03:21.440
in writing to the city clerk's office or your alderman,

03:21.440 --> 03:24.840
where they can be properly documented directly for response.

03:24.840 --> 03:28.480
There will be 13 speakers this evening.

03:28.480 --> 03:32.280
First one will be Tyler Richards from 1821 Superior Street.

03:32.280 --> 03:33.960
This is the first speakers coming up.

03:33.960 --> 03:35.600
Just know there is a three minute clock

03:35.600 --> 03:38.360
that will come down on the screen here.

03:38.360 --> 03:39.840
And when that three minutes is up,

03:39.880 --> 03:41.120
the microphones are turned off.

03:41.120 --> 03:42.920
That is not a commentary or reflection

03:42.920 --> 03:44.240
of anything you're saying,

03:44.240 --> 03:46.480
where there is an effort to treat everyone equally,

03:46.480 --> 03:49.920
everyone gets up to three minutes to say their piece.

03:49.920 --> 03:54.920
So soon we get the clock up and now you may begin.

03:55.120 --> 03:58.280
Hello, my name is Taylor Richards, 1821 Superior Street.

03:58.280 --> 04:00.240
Thank you all for hearing me today.

04:00.240 --> 04:01.520
I'd just like to show my support

04:01.520 --> 04:04.240
for the Shoe Renovation Project.

04:04.240 --> 04:05.760
I think in the grand scheme of things,

04:05.760 --> 04:07.920
it would be a benefit not only to the community,

04:07.920 --> 04:11.200
but to wildlife as well, with the wetland restoration

04:11.200 --> 04:14.080
and the shoreline protection.

04:14.080 --> 04:16.080
I think it's really, you got to look

04:16.080 --> 04:17.200
at the big picture for it.

04:17.200 --> 04:19.120
So I think that would be pretty beneficial.

04:20.720 --> 04:23.160
Not only that the Johnson Leopold family

04:23.160 --> 04:24.800
has done so much for the community,

04:24.800 --> 04:26.840
the Kaiser family is known for doing a lot

04:26.840 --> 04:30.160
for public courses in Wisconsin,

04:30.160 --> 04:32.520
as well as throughout the nation.

04:32.520 --> 04:36.920
Keeping it affordable, but also making it a high end

04:36.960 --> 04:38.760
want to be placed to golf.

04:38.760 --> 04:41.400
I think it would bring in a lot of potential.

04:41.400 --> 04:43.520
Thank you all very much for hearing me out.

04:48.800 --> 04:52.520
Second speaker today will be Wendy Kuo from 2319,

04:52.520 --> 04:53.520
West High Street.

04:58.880 --> 05:00.040
Hi, my name is Wendy Kuo.

05:00.040 --> 05:03.840
I am here to speak about some of the public safety

05:03.840 --> 05:07.160
and tavern situations.

05:07.160 --> 05:10.160
I own a couple of the taverns in the city of Racine.

05:10.160 --> 05:12.440
Other owners and myself have gotten together

05:12.440 --> 05:14.200
to discuss a few situations

05:14.200 --> 05:17.480
between our establishments and the city.

05:17.480 --> 05:19.360
I've been watching or ongoing,

05:19.360 --> 05:21.240
I've been watching or going to public safety

05:21.240 --> 05:24.120
and licensing meetings for the last 10 to 12 years.

05:25.120 --> 05:28.520
The board is always changing and so are the opinions,

05:28.520 --> 05:31.560
which is not, so are the opinions,

05:31.600 --> 05:34.080
which is necessarily not a bad thing.

05:34.080 --> 05:37.080
The problem is there are no guard lines for us

05:37.080 --> 05:39.160
or the board that are put in place.

05:39.160 --> 05:41.440
We are trying to follow the city ordinances

05:41.440 --> 05:44.680
and state laws as we know and understand them.

05:44.680 --> 05:46.800
The public safety and licensing board

05:48.800 --> 05:52.800
spends eight minutes of training when the board switches.

05:52.800 --> 05:55.080
Eight minutes of training is not enough

05:55.080 --> 05:58.600
to hold our livelihood in your hands.

05:58.640 --> 06:01.240
Five years ago, we were told to police

06:01.240 --> 06:04.760
what was going on outside and around our establishments.

06:04.760 --> 06:08.080
Two years ago, when a tavern owner was shot,

06:08.080 --> 06:11.440
we were told not to, but instead to call the police,

06:11.440 --> 06:14.320
if there was a problem due to we are not trained

06:14.320 --> 06:16.840
to handle all situations.

06:16.840 --> 06:19.520
We are also told if the establishment owner

06:19.520 --> 06:23.080
or if the employees call or ask for helper assistance,

06:23.080 --> 06:25.080
it would not be hold against us.

06:25.120 --> 06:29.520
As long as complete cooperation was given to police,

06:29.520 --> 06:32.080
now it seems we are being asked again

06:32.080 --> 06:33.960
to police our businesses.

06:33.960 --> 06:37.160
All we are asking for is a list of guidelines for us

06:37.160 --> 06:39.960
and anyone who may end up on the public safety

06:39.960 --> 06:43.240
and licensing board for there is no confusion

06:43.240 --> 06:46.560
on either side about what is expected

06:46.560 --> 06:48.800
and no more inconsistency.

06:48.800 --> 06:51.440
A few of the tavern owners would like to meet up

06:51.440 --> 06:53.680
with the few of you, if possible,

06:53.680 --> 06:55.800
who have a meeting at some time.

06:55.800 --> 06:57.360
Thank you, I appreciate your time.

06:59.840 --> 07:04.200
Our next speaker will be Jeff Neubon from 1145 Main Street.

07:13.240 --> 07:16.160
Good evening, ladies and gentlemen of the council.

07:16.160 --> 07:19.160
Thank you for this opportunity to be with you.

07:19.160 --> 07:21.160
For those of you who are on the executive committee,

07:21.160 --> 07:22.280
you heard me last week,

07:22.320 --> 07:24.320
who have apologies to all of you.

07:24.320 --> 07:27.600
This is for everyone who wasn't here at that time.

07:27.600 --> 07:30.960
I'm a fourth generation resident to the city of Racine

07:30.960 --> 07:33.920
and I come here to express my strong support

07:33.920 --> 07:37.120
for the proposal to move forward with Shoop Park.

07:37.120 --> 07:40.480
Shoop is a wonderful asset for our community.

07:40.480 --> 07:44.120
It has very extensive deferred maintenance as you know

07:44.120 --> 07:46.560
and we'll probably hear tonight.

07:46.560 --> 07:50.120
Under this proposal for no cost to city residents

07:50.160 --> 07:53.400
and I am one of them, as is my family.

07:53.400 --> 07:57.320
This is an opportunity to greatly enhance that asset

07:57.320 --> 08:01.240
with a fabulous investment of $10 million.

08:01.240 --> 08:04.480
This work will be done extremely well.

08:04.480 --> 08:07.840
The plans are impressive, but most importantly,

08:07.840 --> 08:11.560
the Leopold Johnson group will do this right

08:11.560 --> 08:15.640
because everything they do, they do well.

08:15.640 --> 08:20.000
Every Johnson Leopold project is done with excellence,

08:20.000 --> 08:23.440
with beauty and with integrity.

08:23.440 --> 08:27.320
And from a multi-generational perspective,

08:27.320 --> 08:30.320
the Johnsons have been investing in this community

08:30.320 --> 08:35.320
for six generations with another generation now on the way.

08:35.520 --> 08:39.200
They have always invested with a multi-generational

08:39.200 --> 08:44.000
perspective, this will not solve all of our city's problems

08:44.000 --> 08:48.440
but it will avoid $1.8 million in expense to the city

08:48.440 --> 08:52.280
which the city does not have the resources to invest,

08:52.280 --> 08:57.280
greatly enhance the property to the tune of $10 million,

08:57.760 --> 09:01.800
generate new revenue to the city itself,

09:01.800 --> 09:04.000
bring significant new money to the city

09:04.000 --> 09:07.960
from restaurants, hotels and visitors who will come

09:07.960 --> 09:11.920
to now utilize this beautiful asset even more

09:11.920 --> 09:15.200
than they do now, which will then create jobs

09:15.240 --> 09:17.880
and which we would otherwise not receive.

09:18.960 --> 09:22.480
I've been walking at this site and enjoying it

09:22.480 --> 09:26.120
since our children were little and I have to say

09:26.120 --> 09:30.200
we would go there with my mom, my daughter Greta

09:30.200 --> 09:33.200
and her sisters and my mom would have to sit up

09:33.200 --> 09:36.560
on the bluff and watch us, which she enjoyed,

09:36.560 --> 09:38.360
but she couldn't climb over the trees

09:38.360 --> 09:41.840
and all the obstacles that have accumulated over the years.

09:41.840 --> 09:44.760
So I can't wait to walk on this beach

09:44.800 --> 09:48.240
and on this site on these paths with Greta's new

09:48.240 --> 09:51.040
six-week-old daughter when I'm of the age

09:51.040 --> 09:53.200
when I won't be able to climb over trees

09:53.200 --> 09:55.520
and stumps and other obstacles.

09:55.520 --> 09:59.640
So I look forward to the opportunity that we have before us.

09:59.640 --> 10:02.320
Thank you for your service on the council

10:02.320 --> 10:05.400
and for your, hopefully your support for this proposal.

10:08.320 --> 10:11.760
Next speaker will be Don Horne, 6317 Taylor Ave.

10:15.200 --> 10:20.200
Hello, my name is Don Horne and I'm here tonight

10:20.720 --> 10:24.200
just to talk a little bit about public safety and licensing.

10:24.200 --> 10:28.200
I want to thank Alder Kelly for proposing

10:28.200 --> 10:33.200
to review the loitering ordinance.

10:34.680 --> 10:37.040
I think that's going to be great.

10:37.040 --> 10:41.800
I'm hoping that what I have to say starts here.

10:41.800 --> 10:44.440
We appreciate public safety and licensing so much

10:44.440 --> 10:46.440
in what they do for us.

10:46.440 --> 10:49.720
We would like to see more consistency

10:49.720 --> 10:54.600
in what the decisions are that we are held to,

10:54.600 --> 10:57.720
the standards, this is our livelihood.

10:59.080 --> 11:01.920
We're being held accountable for knowing all the ordinances

11:01.920 --> 11:06.920
for our businesses and we would like to see them the same.

11:09.080 --> 11:12.440
So we would like some more, them did get more education.

11:12.440 --> 11:15.120
I hope that after review of the,

11:19.000 --> 11:21.640
I hope that after reviews are made,

11:21.640 --> 11:24.560
that tickets are actually going to be cited

11:24.560 --> 11:27.720
to those people that are loitering

11:27.720 --> 11:29.800
and causing our businesses stress.

11:30.760 --> 11:33.200
We haven't seen that in the past.

11:33.200 --> 11:35.040
So we're really looking forward to that.

11:35.040 --> 11:36.760
We appreciate the police liaisons

11:36.760 --> 11:39.040
that's on the public safety and licensing board.

11:39.040 --> 11:41.200
He has done a lot for our businesses

11:41.240 --> 11:44.120
as far as giving us details, outcomes,

11:44.120 --> 11:48.600
and then also evidence.

11:48.600 --> 11:51.160
I'm sad to say that lately,

11:51.160 --> 11:53.080
I've been watching public safety and licensing

11:53.080 --> 11:54.720
for about four or five years.

11:54.720 --> 11:59.720
And lately, our social media has been,

12:00.120 --> 12:02.600
I feel, affecting the decisions that are made.

12:02.600 --> 12:04.480
And I hope that changes.

12:08.920 --> 12:10.920
Let's see where my hands are.

12:11.920 --> 12:14.920
So tonight, I just, I'm hoping that it starts here

12:14.920 --> 12:18.920
with common counsel to hold everybody, not only us,

12:18.920 --> 12:21.920
but also the alderman that sit on the board

12:21.920 --> 12:23.920
for public safety and licensing,

12:23.920 --> 12:26.920
and hopefully the inconsistencies stop,

12:26.920 --> 12:28.920
and so does the bias.

12:28.920 --> 12:30.920
I know the owner too.

12:34.920 --> 12:36.720
Next speaker will be Colin R.

12:37.720 --> 12:42.720
Next speaker will be Colin McKinley, 724 Crabtree.

12:45.720 --> 12:47.720
I'm leaving.

12:47.720 --> 12:52.720
Dr. Shoop had plenty history in Racine.

12:53.720 --> 12:58.720
Back in 1917, Dr. Shoop donated 52 acres along the shore

12:58.720 --> 13:01.720
of Lake Michigan to the people of Racine

13:01.720 --> 13:06.720
to be used as a public part in Poon unity forever.

13:15.720 --> 13:20.720
And two parts should not become a larger golf course.

13:21.720 --> 13:24.720
Johnson, Leopold, and Caser Group.

13:24.720 --> 13:29.720
Their plan is harmful to the environment.

13:32.720 --> 13:37.720
Because it's going to cut down all the trees on the shoreline.

13:39.720 --> 13:44.720
And it's going to take green space

13:45.720 --> 13:50.720
and more parking at the Racine Lighthouse,

13:50.720 --> 13:54.720
which is important to have that green space

13:54.720 --> 13:57.720
for the Racine Lighthouse.

13:57.720 --> 14:01.720
I'm sure Dr. Shoop would not approve

14:01.720 --> 14:06.720
a private investor using the land he donated

14:06.720 --> 14:10.720
as a public part to make a profit.

14:11.720 --> 14:18.720
So not only will golf be taking up every square inch of shoe,

14:19.720 --> 14:24.720
their plan, they want to enroach the lighthouse ground.

14:25.720 --> 14:28.720
Dr. Shoop gave the land to everyone,

14:28.720 --> 14:30.720
and he signed a deed.

14:30.720 --> 14:37.720
And it says that the land should be used as a public park.

14:38.720 --> 14:45.720
And it does it says anywhere about a golf course.

14:45.720 --> 14:51.720
And one other thing, the City Council, in agreement,

14:51.720 --> 14:58.720
you signed a 10 year lease with members of the Johnson family.

14:58.720 --> 15:04.720
The agreement calls for a 10 million new clubhouse

15:05.720 --> 15:10.720
installing a 10 year lease,

15:10.720 --> 15:16.720
which they will donate 2 million offset of construction.

15:16.720 --> 15:19.720
And I think that's a bribe.

15:19.720 --> 15:25.720
Because why I think it's a bribe?

15:25.720 --> 15:30.720
Because they want you to vote for this.

15:30.720 --> 15:36.720
So I hope you vote no for the people in the community vote no.

15:41.720 --> 15:43.720
Next speaker will be Melissa Warner,

15:43.720 --> 15:48.720
3-3-3, late gap.

15:48.720 --> 15:50.720
Good evening, council.

15:50.720 --> 15:53.720
Thank you for the opportunity to meet with you once again.

15:53.720 --> 15:56.720
You have a hard decision to make tonight.

15:56.720 --> 15:59.720
It's hard because you can't see the future.

15:59.720 --> 16:01.720
None of us can.

16:01.720 --> 16:05.720
And this decision will have consequences far into the future.

16:05.720 --> 16:10.720
We can't know whether Racine youth will think a Caddy school is a good idea.

16:10.720 --> 16:14.720
We cannot know how far away people will come,

16:14.720 --> 16:16.720
and in fact golfers will come.

16:16.720 --> 16:17.720
You can't know that.

16:17.720 --> 16:18.720
We can project it.

16:18.720 --> 16:21.720
We can think about it, but we can't know it.

16:21.720 --> 16:26.720
We want more certainty than is available.

16:26.720 --> 16:30.720
However, there are some things I know, or at least I think I know.

16:30.720 --> 16:35.720
First, the bluff along our lakefront is built mostly of glacial debris

16:35.720 --> 16:38.720
and very susceptible to erosion.

16:38.720 --> 16:42.720
Two, water levels in Lake Michigan vary sometimes by a lot.

16:42.720 --> 16:47.720
And they will be much higher than they are now at some time.

16:47.720 --> 16:54.720
The storms we get seem to be increasing in fury and intensity and frequency.

16:54.720 --> 16:56.720
What does all of that mean?

16:56.720 --> 17:03.720
It means there will be a storm that will take out the bluff.

17:03.720 --> 17:09.720
So your decision is more sooner or later than yes or no.

17:09.720 --> 17:10.720
Do we know when?

17:10.720 --> 17:12.720
Of course not.

17:13.720 --> 17:18.720
Another thing I think I know, the industry and manufacturing that we had in Racine

17:18.720 --> 17:24.720
is not coming back in anything like the level it was when we moved here some 45 years ago.

17:24.720 --> 17:26.720
What can take its place?

17:26.720 --> 17:28.720
Tourism.

17:28.720 --> 17:31.720
I don't have the data, but I'll bet you visit Racine does

17:31.720 --> 17:36.720
on what tourism is already bringing in to Racine.

17:36.720 --> 17:41.720
And we are ideally suited as a tourist vacation hotspot.

17:41.720 --> 17:47.720
We have the lake, the beach, the marinas, the zoo, good theater, music, lots of music,

17:47.720 --> 17:50.720
and museums, a thriving art community.

17:50.720 --> 17:56.720
But this project is an opportunity to add something that is uniquely Racine

17:56.720 --> 17:59.720
and not found elsewhere in our area.

17:59.720 --> 18:08.720
So if I were sitting in your seat tonight, I would grit my teeth and vote yes.

18:08.720 --> 18:26.720
Next speaker will be Mary Gardiola, 5100 Charles Street.

18:26.720 --> 18:27.720
Hello.

18:27.720 --> 18:30.720
I sent you all an email earlier today.

18:30.720 --> 18:32.720
I hope you had a chance to read it.

18:32.720 --> 18:33.720
There's so much more detail.

18:33.720 --> 18:37.720
I just want to cover just what was on the top of my head.

18:37.720 --> 18:42.720
If this proposal passes as written, we will be left with a sand dune style golf course,

18:42.720 --> 18:47.720
a large putting green cafe and parking lot to include a rough surface walking path

18:47.720 --> 18:50.720
and trail open to the public.

18:50.720 --> 18:54.720
The plan simply would not include any public park space for our community to use

18:54.720 --> 18:56.720
for various other park interests.

18:56.720 --> 19:02.720
My point is that we can have a park and a park for park goers

19:02.720 --> 19:06.720
and a world-class golf course for the golfers as well.

19:06.720 --> 19:09.720
We don't need to have one or just the other.

19:09.720 --> 19:14.720
There are too many open ends still existing to move forward.

19:14.720 --> 19:19.720
But putting a delay on the current proposal we have here today taking a pause

19:19.720 --> 19:23.720
to consider and reconsider including both groups of interest

19:23.720 --> 19:28.720
makes the most sense of the changes that will be happening going forward.

19:28.720 --> 19:31.720
I'm asking you to please pause on the vote.

19:31.720 --> 19:35.720
Thank you.

19:35.720 --> 19:44.720
The next speaker is Michael Burke, 1232, Florence Avenue.

19:44.720 --> 19:45.720
Hi.

19:45.720 --> 19:49.720
As president of Hoi Audubon Society, I must voice our opposition

19:49.720 --> 19:54.720
to the proposed redevelopment of Shoe Park Golf Course as we understand it.

19:54.720 --> 19:57.720
Birds are in steep decline in the U.S. and Canada.

19:57.720 --> 20:03.720
Nearly 3 billion breeding adults gone since 1970 according to Cornell University,

20:03.720 --> 20:06.720
the absolute experts on North American birds.

20:06.720 --> 20:10.720
Shoe Park has been a place where they find safe harbor.

20:10.720 --> 20:13.720
Frankly, it has been very challenging for us to clearly grasp

20:13.720 --> 20:17.720
what will happen to Shoe if the redevelopment is approved.

20:17.720 --> 20:22.720
On one hand, I and a few other board members have heard some encouraging things

20:22.720 --> 20:24.720
from members of the redevelopment team.

20:24.720 --> 20:27.720
However, the pretty pictures we see of their vision

20:27.720 --> 20:32.720
leaves us with the impression that Shoe could become a very barren place.

20:32.720 --> 20:37.720
At least closest to the lake, where big changes would do the most harm to birds.

20:37.720 --> 20:42.720
Windpoints and Shoe Park are so critical to birds because the area lies along

20:42.720 --> 20:44.720
a major north-south migratory route.

20:44.720 --> 20:49.720
Because windpoint is a promontory, it is a natural place for migrating birds

20:49.720 --> 20:52.720
to stop, rest and refuel during their journey.

20:52.720 --> 20:58.720
There are very few dark, relatively safe areas for birds to stop along that migratory route.

20:58.720 --> 21:00.720
But that area is a premier one.

21:00.720 --> 21:04.720
Shoe provides the underbrush, the cover right along the lake

21:04.720 --> 21:08.720
that migrating birds need to avoid predation.

21:08.720 --> 21:11.720
The farther they fly without being able to rest and find nourishment,

21:11.720 --> 21:14.720
the more are likely to perish along the way.

21:14.720 --> 21:17.720
With Shoe Park's location and rich natural habitat,

21:17.720 --> 21:21.720
more than 270 bird species have been identified at Shoe and Windpoint,

21:21.720 --> 21:26.720
making the area one of the very top areas for birds in our entire state.

21:26.720 --> 21:32.720
For those reasons and more, Hui Audubon Society opposes the redevelopment plan as proposed.

21:32.720 --> 21:38.720
The Wisconsin Ornithological Society has just weighed in on the Dunes golf course plan as well.

21:38.720 --> 21:40.720
In a letter that begins, quote,

21:40.720 --> 21:46.720
we urge the city of Racine and project planners to preserve Shoe Park golf course's natural shoreline,

21:46.720 --> 21:52.720
mature trees and bird habitat while using targeted bird-friendly management practices

21:52.720 --> 21:56.720
to address safety, erosion, lighting and course maintenance needs.

21:56.720 --> 22:02.720
Still quoting, removing large numbers of trees would cause significant harm to the habitat used by migrating birds.

22:02.720 --> 22:08.720
During migration, birds need cover of trees, shrubs and brush to rest, hide from predators and find food.

22:08.720 --> 22:16.720
I encourage planners to find the WSO's letter containing numerous suggestions for ways that birds and golfers could coexist on its website.

22:16.720 --> 22:22.720
I will end by adding my own opinion that the redevelopment proposal has some merits,

22:22.720 --> 22:27.720
but I believe there would be many ways to accomplish these with less impact on Shoe's natural environments.

22:27.720 --> 22:37.720
If approved, I plead with the developers to proceed with some moderation and with utmost respect for Shoe's benefits for birds in wildlife. Thanks.

22:37.720 --> 22:43.720
Our next speaker is Fantasia Edwards, 332621st Street.

22:47.720 --> 22:54.720
Hello. I'm here to discuss the proposal for the Shoe Park.

22:54.720 --> 23:03.720
I personally think that there can be both golfers and birds in leaving wildlife as it is.

23:03.720 --> 23:10.720
I believe that if it's done in good faith, the private investors will donate to the golf course,

23:10.720 --> 23:19.720
but then they also will donate to the city to ensure that the coastline, the shoreline is restored to its natural habitat or left as it is.

23:19.720 --> 23:23.720
I think that, I'm going to nervous.

23:23.720 --> 23:30.720
I personally think it's also a deep violation. If someone gave you a gift, are you going to then give it to someone else?

23:30.720 --> 23:37.720
The park was donated to the people, so it should stay for the people.

23:37.720 --> 23:42.720
Also, how does the golf course present day contribute to the community?

23:42.720 --> 23:45.720
That's food for thought.

23:45.720 --> 23:54.720
Also, I wanted to know if we're really concerned about the shoreline and wildlife, how come now it's a discussion?

23:54.720 --> 24:01.720
How come it wasn't a discussion beforehand when the people came in to donate the money?

24:01.720 --> 24:20.720
If that makes sense, why would everyone say, yes, renovate it, but how come everyone cares now about the shoreline and the dunes and the birds, unless it's something personal gain?

24:20.720 --> 24:42.720
If your job is to be for the people, you need to listen to them, and this will also instill trust that we can trust you with our lands and the safety of our city.

24:42.720 --> 24:57.720
If you want us to trust you, you have to show us that we can trust you by doing the right thing, which is leaving the shoreline as it is, but given the golf course, the opportunity to be renovated.

24:57.720 --> 25:08.720
If they decide to take, I just don't think that you can restore the shoreline, but don't think that you can take parts of other land.

25:08.720 --> 25:16.720
Restore the clubhouse, do what's on that land, but don't think you're going to touch the park, because that's off limits.

25:16.720 --> 25:20.720
Thank you.

25:20.720 --> 25:29.720
Next speaker will be Phil Politi, 15522, 73rd Street, Kenosha.

25:29.720 --> 25:37.720
Good evening. My name is Phil Politi, and I'm the executive director of the Caddy and Leadership Academy of Southeast Wisconsin.

25:37.720 --> 25:48.720
Our mission is to develop outstanding young men and women into excellent and exceptional students and to qualify these students for the Evan Scholarship.

25:48.720 --> 25:56.720
For the committee members that aren't familiar with that, the Evan Scholarship is the largest privately funded college scholarship program in the world.

25:56.720 --> 26:06.720
Currently, there are 1,300 students in college with a full four-year tuition and housing scholarship at 28 different universities.

26:06.720 --> 26:14.720
Here in Wisconsin, Evan's has a presence at University of Wisconsin-Madison, and also Marquette University.

26:14.720 --> 26:31.720
And our goal, partnering with the SHU project, is to use SHU as a training ground for middle school students to get them trained up and graduate into full-scale Caddy programs in the area.

26:31.720 --> 26:44.720
Currently, we have a program at Meadowbrook Country Club in Racine, and since 2021, we've had nine students pictured here received the full Evan Scholarship.

26:44.720 --> 26:52.720
Most of those students have gone on to the University of Wisconsin. They live in the Evan Scholarship House with other students who have caddied.

26:52.720 --> 27:00.720
These students were awarded the scholarships based on their outstanding academics, their Caddy record, and a demonstrated family financial need.

27:00.720 --> 27:09.720
We target recruit students who have excellent academics, but I would say at risk.

27:09.720 --> 27:21.720
Since I started this program, I founded this program in 2014. We got real serious with it in about 2019, and since then we've had 32 of our students receive this scholarship.

27:22.720 --> 27:36.720
Just to give you an idea of the kind of impact they can have on these young people, if they were to go to Marquette University and pay full force, that scholarship is worth $320,000 over four years.

27:36.720 --> 27:41.720
The value of an Evan Scholarship at University of Wisconsin is about $150,000.

27:42.720 --> 27:53.720
We look to use SHUP as an opportunity to find these students, recruit them, train them, and get them in the pipeline for the Evan Scholarship.

27:53.720 --> 28:09.720
It is the most successful scholarship program in the country, and partnering with the folks, the Leopold, the Johnson family, to provide this opportunity to truly life-changing opportunities for these young people.

28:09.720 --> 28:22.720
I urge you with all my heart and for the benefits of the young middle school students in Racine, please approve this project so we can use it as a platform to change these young people's lives.

28:22.720 --> 28:25.720
Thank you.

28:26.720 --> 28:31.720
Next speaker is Christine Kern, 4115 Leopold House Drive.

28:43.720 --> 28:54.720
Hi, my name is Christine Kern, and thank you for letting me speak. I'm actually reading for Abigail King information that she sent to the council.

28:54.720 --> 29:04.720
So, the concern here is not that SHUP Park should be left exactly as it is, it shouldn't.

29:04.720 --> 29:09.720
The bluff is eroding, the buildings are a passer service life, and the grounds have been neglected.

29:09.720 --> 29:16.720
The concern is the specific decision in front of you tonight, a 50-year private lease approved before the science of permits.

29:16.720 --> 29:18.720
The deed questions have been answered.

29:18.720 --> 29:36.720
This vote commits a park before any permit exists, your own briefing memorandum states that the developer will be required to obtain approvals for the City Planning Heritage and Design Commission, the Wisconsin Department of Natural Resources, the Army Corps of Engineers, and all other legally required authorizations.

29:37.720 --> 29:40.720
In plain terms, none of these approvals exist yet.

29:40.720 --> 29:44.720
The Department of Public Works report says the same of the shoreline.

29:44.720 --> 29:50.720
Final approval of the revetment plans rests with the DNR and the Army Corps.

29:50.720 --> 29:57.720
If you are being asked to sign a 50-year commitment first and to learn whether it is even permitable second.

29:57.720 --> 30:01.720
If those permits are later denied or heavily conditioned, the city is already bound.

30:01.720 --> 30:05.720
On the wetlands, the state has already ruled against this project.

30:05.720 --> 30:13.720
On November 14, 2025, the Wisconsin DNR denied the developer's request to treat six of the sites wetlands as artificial.

30:13.720 --> 30:21.720
The DNR found that all six carry a natural wetland history predating 1991 and remain protected under state law.

30:21.720 --> 30:23.720
That is not a hurdle the applicant has cleared.

30:23.720 --> 30:25.720
It is one the state has already raised.

30:25.720 --> 30:31.720
The plan still speaks of managing the existing wetland and regrading the course into Dune and Prairie.

30:31.720 --> 30:39.720
Any impact to those confirmed wetlands now requires full individual permitting, including proof that harm was avoided

30:39.720 --> 30:41.720
and that real alternatives were studied.

30:41.720 --> 30:44.720
That analysis has not been placed before you.

30:44.720 --> 30:47.720
The word restoration does not match the plan.

30:47.720 --> 30:52.720
The project is presented as environmental restoration,

30:52.720 --> 30:57.720
but it calls for the select clearing of golf course trees, more than half a mile of engineered stone revetment

30:57.720 --> 31:04.720
and rip rap along the Lake Michigan shoreline and the regrading of landform into Dune and Fescue course.

31:04.720 --> 31:10.720
Windplain and Shoe Park are a recognized birding area as we have heard.

31:10.720 --> 31:13.720
This would be altered.

31:13.720 --> 31:17.720
The developer's own reputation is described in this presentation,

31:17.720 --> 31:23.720
which is a very important process on choosing remarkable natural settings and letting the land lead the design,

31:23.720 --> 31:28.720
armoring a living shoreline in rock and clearing mature campy is the opposite of that philosophy.

31:28.720 --> 31:33.720
It is fair to ask why the plan contradicts the very brand it offered to justify it.

31:33.720 --> 31:38.720
The 1917 deed question should be answered first.

31:38.720 --> 31:44.720
We're really asking that you delay the vote and think about this for a while.

31:44.720 --> 31:47.720
Thank you so much.

31:47.720 --> 31:53.720
Our next speaker tonight will be Greg Mankie for Spruce Wood.

32:00.720 --> 32:01.720
Good evening.

32:01.720 --> 32:02.720
I'm Greg Mankie.

32:02.720 --> 32:04.720
Thanks for allowing me to speak.

32:04.720 --> 32:07.720
I'm a lifelong Racine and 20-year wind point resident.

32:07.720 --> 32:10.720
I'm actually here to speak in favor of the Shoe Park development.

32:10.720 --> 32:17.720
I've played Shoe Park many times over the years and have always wondered how we could have this beautiful piece of land

32:17.720 --> 32:24.720
on Lake Michigan with this iconic lighthouse but have this subpar golf course that's always been poorly maintained

32:24.720 --> 32:26.720
and for those reasons underused.

32:26.720 --> 32:28.720
It has so much potential.

32:28.720 --> 32:35.720
I go by Shoe most every day either walking or driving and rarely see more than a few golfers here and there.

32:36.720 --> 32:42.720
I believe in the Johnson Leopold family and what they've already done for the city of Racine speaks for itself.

32:42.720 --> 32:45.720
I don't believe the developers will be reckless.

32:45.720 --> 32:48.720
I believe they will take people's concerns seriously.

32:48.720 --> 32:51.720
I have personally met Craig Halton from the Kaiser group.

32:51.720 --> 33:01.720
I've listened to him speak and believe he and they are genuine and will do a fantastic job as they have on their many other projects.

33:02.720 --> 33:07.720
I think people driving by just to drive along the lake shore or go see the lighthouse may not even recognize

33:07.720 --> 33:12.720
it's a golf course but they will be amazed at how beautiful the property is.

33:12.720 --> 33:19.720
This will give people a reason to come to Racine and when they're here maybe they will stay at our downtown hotel

33:19.720 --> 33:23.720
or eat at a restaurant or stop at a bakery and pick up a cringle or two

33:23.720 --> 33:27.720
and then go home and tell their friends how nice it was.

33:27.720 --> 33:29.720
Give them the reason to come.

33:30.720 --> 33:37.720
I think as a resident to pay $24 to play on a beautiful golf course that two hours north would cost $500.

33:37.720 --> 33:40.720
That would be a gift to local golfers.

33:40.720 --> 33:46.720
I think people will be amazed at how beautiful it is when it's finished and what a gem it will be for our city.

33:46.720 --> 33:50.720
I'm just asking you to think of moving forward and not backwards.

33:50.720 --> 33:54.720
I think if we pass up this opportunity we will be moving backwards.

33:54.720 --> 34:02.720
Shoop has never been utilized to its potential by the city and there's no reason to believe that it can be in the future.

34:02.720 --> 34:09.720
I believe this project will benefit our entire community moving forward and I ask that you vote in favor.

34:09.720 --> 34:12.720
So thank you for listening.

34:13.720 --> 34:18.720
Speaker will be Karen Johnson 5062 Hunt Club Road.

34:29.720 --> 34:34.720
Mr. Mayor, members of the Common Council and distinguished guests, my name is Karen Johnson

34:34.720 --> 34:40.720
and I stand before you today not just as a resident but as someone whose families go back generations in Racine.

34:40.720 --> 34:47.720
To you Mr. Mayor and to the alderman, I am here to offer some ideas that I think will offer a compromise with the Lighthouse Dunes.

34:47.720 --> 34:54.720
Through the chair to the developer present today, like you I have deep roots in the community and a connection.

34:54.720 --> 35:02.720
My father Bud Nelson knew your parents very well and my grandfather and great-grandfather built the Johnson-Wankstower for your grandfather.

35:02.720 --> 35:08.720
As a lifelong recipient I do appreciate the many things your family has done to give back to this community.

35:08.720 --> 35:17.720
In regards to the new venture Lighthouse Dunes, I do believe on its surface it can and will be a wonderful asset and will bring a lot of new people to our village.

35:17.720 --> 35:22.720
But I don't think it should be at the expense of other important things that will be taken away.

35:22.720 --> 35:30.720
First of all our 3000 foot wild shoreline is home to a critical migratory flyway with over 270 bird species recorded.

35:31.720 --> 35:37.720
Hoiata Ban in Wisconsin Society for Ornithology are the leading voices in the preservation of these critical habitats.

35:37.720 --> 35:43.720
They both have scientific evidence that migratory birds cannot survive in a prairie dune habitat.

35:43.720 --> 35:48.720
Moving the sanctuary across the street won't work because the birds need everything on the shore.

35:48.720 --> 35:53.720
I hope you will compromise your plans and install a living shoreline into your plans as they suggest.

35:53.720 --> 36:00.720
I do have a letter that the Wisconsin Society of Ornithology asks that I deliver to the council and to Helen and Craig today.

36:00.720 --> 36:11.720
Second on the subject of discount fees I am certain that this was an oversight on your part but written into the proposal is a statement that only city of Racine residents will receive discount.

36:11.720 --> 36:14.720
I just found out that wind point will too.

36:14.720 --> 36:21.720
I would hope that the Lighthouse Dunes develop different tiers of discounts so that all Racine residents can enjoy the benefits of the course.

36:21.720 --> 36:26.720
Of course, charge as much as you want to out of towners but make it affordable for our residents.

36:26.720 --> 36:30.720
Again, thank you to everyone who has worked very hard, saved the trees.

36:30.720 --> 36:41.720
Hoiata Ban in the Wisconsin Society of Ornithology and to the Johnson Leopold family for listening to our ideas and hopefully including them into our plan. Thank you.

36:42.720 --> 36:48.720
And the last speaker for today will be Kevin Zilber, five cedar board.

36:52.720 --> 37:01.720
Good evening. I'm Kevin Zilber, lifetime Racine resident and now living in the wind point area adjacent to the shoe golf course.

37:01.720 --> 37:06.720
And I'm here to speak on behalf of the proposal and its passage.

37:07.720 --> 37:16.720
I won't pull out my prepared remarks only because it would be somewhat repetitive but I do think that, first of all, very impressed by the engagement on both sides.

37:16.720 --> 37:25.720
And while any project has pros and cons, it is my judgment that the pros far outweigh the cons in this case.

37:25.720 --> 37:29.720
We do have a great, great piece of land there.

37:29.720 --> 37:35.720
I have done homework on the Kaiser group and looked at some of the other projects they've done.

37:35.720 --> 37:46.720
All of which have been done with respect to the communities and honoring the wishes of those communities and have been generally rated very, very high and productive.

37:46.720 --> 37:54.720
We do need to move forward. We have a declining infrastructure at Shoops and I do think it would be great for the community advancement.

37:54.720 --> 38:00.720
I've also used some of the caddies at Metalbrook. I know the program.

38:01.720 --> 38:07.720
I've helped advance some of the people of the Evan scholarship. I know what an impact it has on people's lives.

38:07.720 --> 38:17.720
And so there's a lot of, again, when I look back at the pros and cons, is much, much more positive and I think it's going to be a great way to advance our community.

38:17.720 --> 38:23.720
Put us on the map and allow us to move forward together. So thank you for your time.

38:31.720 --> 38:34.720
This concludes the public comment section.

38:34.720 --> 38:39.720
Thank you. We'll then move on to a presentation by the Leopold Johnson Golf Group.

38:39.720 --> 38:44.720
Many of you were here to see the presentation at executive committee.

38:44.720 --> 38:55.720
So we've asked the Johnson and Leopold group to maybe give an abbreviated presentation that they did last time and then offer the opportunity for elders who were there or not there to ask any additional questions they might have.

38:55.720 --> 39:00.720
So if you'd like to come up to the DS, Greg.

39:06.720 --> 39:15.720
Good evening. Thank you, Mr. Mayor, council members. Thank you very much for listening to what we have to say.

39:15.720 --> 39:23.720
It obviously is a very, it's a topic that there are people that have a high level of interest in.

39:23.720 --> 39:30.720
I will keep my remarks much shorter than I did previously.

39:30.720 --> 39:43.720
And as I sit here, I think I want everybody to appreciate what we're trying to do.

39:43.720 --> 39:49.720
This is something that we're not doing to make a profit. We never will make a profit.

39:49.720 --> 39:59.720
I think it was Alderman Mack that asked at the executive committee meeting, you know, when will you get your $10 million back?

39:59.720 --> 40:04.720
And I think my answer was never. We will never get it back.

40:04.720 --> 40:12.720
This is something that Helen and I drive by this course, except there's construction going on right now.

40:12.720 --> 40:20.720
But we drive by it twice a day. And I can tell you, if you drive by, you cannot see the lake.

40:20.720 --> 40:33.720
We drive on the lighthouse drive. We cannot see the lake. It is overgrown with bushes and trees that are invasive trees.

40:33.720 --> 40:41.720
And I understand the concern that a lot of people have.

40:41.720 --> 40:54.720
I think what I would merely ask is when we're referred to as developers, we are not developers.

40:54.720 --> 41:02.720
All right, we're trying to do this because we are a generational family.

41:02.720 --> 41:08.720
We will always be in this city. This is our home. This is where our kids all work now.

41:08.720 --> 41:22.720
And they're getting involved in, you know, what our family companies and they understand that you do things sometimes because it's the right thing to do.

41:22.720 --> 41:31.720
And this is one of those things. I think it's going to be an awesome thing for us to do.

41:31.720 --> 41:42.720
And when I use the term investment, I'm talking about investing in that property to bring it back to where it should be.

41:42.720 --> 41:51.720
It is iconic. And one of the very first people who recognize that was a gentleman named Mike Kaiser.

41:51.720 --> 41:58.720
And I have spoken a number of times and certainly with the mayor about the Kaiser group.

41:58.720 --> 42:06.720
They care about the environment. They care about the communities that they do golf courses in.

42:06.720 --> 42:15.720
They care about the trees and the birds and they care about golf and they care about having an unbelievable experience.

42:15.720 --> 42:19.720
So that's who the Kaiser's are.

42:19.720 --> 42:29.720
When I was first aware of the Kaiser group, I knew them because I've been to a number of their golf courses, but I didn't really know them.

42:29.720 --> 42:45.720
Okay. So I investigated and someone gave me a book that was written by the elder Mr. Kaiser, the patriarch of the Kaiser family who started the family golf course, the family business.

42:45.720 --> 42:58.720
And he is a spectacular human being who cares more about what goes on in the communities that they do business and how they treat their employees and how they treat their customers.

42:58.720 --> 43:05.720
And it kind of reminded me of another person that lived in this community and passed away about 15 years ago.

43:06.720 --> 43:14.720
And so when I met the son, Mike Kaiser, he was great.

43:14.720 --> 43:19.720
We spent so much time on the shoe property, walking, everything.

43:19.720 --> 43:24.720
Well, it wasn't walking. I've had four hip replacements, so I was in a golf cart.

43:24.720 --> 43:31.720
And, but we went all around to see it and to understand what it could be.

43:31.720 --> 43:44.720
And he had the vision for this property and the vision is to make this one of the top nine whole golf courses in America.

43:45.720 --> 43:49.720
And he should know because he's got the actually in the world.

43:49.720 --> 43:55.720
He's got number three right now, a nine whole course that is number three on the list.

43:55.720 --> 44:03.720
And he said, he'll never be one or two because those are there for a reason.

44:03.720 --> 44:07.720
He said, but maybe you'll be four because you'll never be three either.

44:08.720 --> 44:17.720
And, you know, it's, you know, this is a project that Helen and I are, you know, we want to do it.

44:17.720 --> 44:20.720
You know, we're not doing it. We don't throw money away. All right.

44:20.720 --> 44:28.720
We, you just don't do that. And we do care about our environment.

44:28.720 --> 44:36.720
And you mentioned the, I'm sorry, I couldn't help, but you mentioned the ornithology department at Cornell.

44:36.720 --> 44:47.720
And it's, it was built by the Johnson family. So it is the imaging Johnson ornithology building at Cornell.

44:47.720 --> 44:54.720
So Helen has a little bit of the bird lovers and the tree and I think that's awesome.

44:54.720 --> 44:59.720
So I can, I can assure you, you will be represented at the table.

44:59.720 --> 45:07.720
And, and of course, as you well know, because you spent a couple hours with Jen's Jensen walking the property.

45:07.720 --> 45:13.720
We've hired Jen. So some of you may recognize that name. He's a very iconic.

45:13.720 --> 45:19.720
Racinean that did most of the parks that we have in our city.

45:19.720 --> 45:26.720
And this is his grandson that now is carrying on the ecological environmental.

45:27.720 --> 45:36.720
Business that his grandfather started. So, so what, so what we want to enter into is a, is a 50 year agreement.

45:36.720 --> 45:42.720
And well, you see, well, that sounds like a long time. And.

45:42.720 --> 45:49.720
For some people, it is a long time for us. It's not. We know our family is going to be here in 50 years.

45:49.720 --> 45:55.720
And, and our, you know, our kids are going to be in this community and they're going to be involved.

45:55.720 --> 46:03.720
And, you know, 50 years is just, you know, it's just 50 years. So, but there are outs.

46:03.720 --> 46:17.720
I mean, if we aren't performing like we should be performing, you know, maybe your children will be the mayor and will call my grandkids in and, you know, they'll have a conversation.

46:17.720 --> 46:28.720
And, and I only say that because I want you to feel comfortable that, that we will do the right thing.

46:28.720 --> 46:35.720
I want to say all the time, but we're going to do it most of the time.

46:35.720 --> 46:43.720
All right. So, so I just, you know, rather than getting into everything and all the details, I just, I think it was even more important.

46:43.720 --> 46:53.720
At least make me feel better and Helen as well that I wanted to share with you that we are listeners.

46:53.720 --> 47:01.720
We will, we will listen. In fact, there was a gentleman here last week at the executive committee meeting. He was a kayaker.

47:01.720 --> 47:11.720
I talked to them afterwards and we're working on a way that he can, you know, that kayakers that want to bring their kayaks in can access down to the lake.

47:11.720 --> 47:26.720
And they were put a little parking spot. If we could get the city to be able to help us to say for kayakers only, we'll probably put the sign up anyway, you know, in hopes that it'll, it'll, it'll be understood that is for kayakers to take their kayaks down.

47:26.720 --> 47:32.720
So I'm saying that we're going to listen to you. And that's kind of the, you know, that's, that's who we are.

47:33.720 --> 47:47.720
So I did a little bit different format rather than kind of go over all the issues and things going on, which I'm more than happy to discuss anything going on in the, in the lease.

47:47.720 --> 47:50.720
But I wanted you more than anything.

47:50.720 --> 47:59.720
I wanted to share with you who we are and, you know, if this is a very important project for us.

48:00.720 --> 48:02.720
We have a few questions on all the Jordans.

48:03.720 --> 48:13.720
Thank you. So you answered most of my questions last week, but in talking with residents, they, they liked the idea that it would be matching Johnson Park.

48:13.720 --> 48:18.720
After the two years of $24.00 is up and they thought that was a great idea.

48:18.720 --> 48:28.720
They did have a question and I didn't have the answer. So I wanted to ask you, they were worried that caddies would be mandatory that they would have to pay the caddy fee and do a caddy.

48:28.720 --> 48:33.720
Even if they just wanted to go do it for the $24.00 and without a caddy.

48:33.720 --> 48:43.720
Absolutely. No caddies are not. There was never any thought process that we had that would have caddies as a, as a requirement to play golf.

48:43.720 --> 48:55.720
You can walk. You can take your pool caddy. We are pool cart. We will not have electric carts or gas carts. So it's, it's still a walking course.

48:55.720 --> 48:59.720
Thank you so much. That was, oh, that's right.

48:59.720 --> 49:04.720
Well, there we go. Just for anyone who didn't hear it, there wasn't with the microphone, but the caddies will be free themselves.

49:04.720 --> 49:07.720
So not even a issue of cost.

49:07.720 --> 49:15.720
I need to keep the conversation between the presenter and the alders and not have commentary from members of the public.

49:15.720 --> 49:16.720
Okay. Please continue.

49:16.720 --> 49:23.720
Well, in hearing that the caddies are free and they're not required, that satisfies my question of that some residents brought up of cost.

49:23.720 --> 49:28.720
It sounds like that's been taken care of as well. So it would just be the $24 for two years.

49:28.720 --> 49:36.720
And then after that, it would be the highest price for nine holes at nine holes, right? Perfect. Thank you so much.

49:36.720 --> 49:37.720
Yep.

49:37.720 --> 49:41.720
Other Davis.

49:41.720 --> 49:44.720
Thank you.

49:44.720 --> 49:51.720
One item that's come up a few times is about the restoration of the shoreline.

49:52.720 --> 50:04.720
Where are you at in the process with the DNR to ensure that they will grant you permission to move forward with that part of it.

50:04.720 --> 50:06.720
Okay. Good question.

50:07.720 --> 50:18.720
The request to do all of the rocks on the shoreline will actually the request will come from the city because the city will continue to own this property.

50:18.720 --> 50:21.720
So it will always be the city's property.

50:21.720 --> 50:27.720
But we have had conversations with the DNR and the Corps of Engineers.

50:27.720 --> 50:32.720
They are very aware of what we want to do.

50:32.720 --> 50:38.720
We live on Lake Michigan and we had to put in a ton of these rocks. So we know the people.

50:38.720 --> 50:53.720
And so that's really where we are right now. I think one of the, one of the questions that I heard before was, was, gosh, why did we go to the DNR, the Corps of Engineers, you know, all these people.

50:54.720 --> 51:05.720
But the final lease agreement is subject to those approvals occurring. So if we don't get the DNR approval and they say, no, you can't do it.

51:05.720 --> 51:12.720
Then we would have to come back and say, okay, as, you know, we're not going to do the shoreline because we weren't able to.

51:12.720 --> 51:18.720
But, but the lease will be subject to getting those approvals.

51:19.720 --> 51:23.720
Thank you. You answered my follow-up question as well.

51:23.720 --> 51:24.720
Okay.

51:27.720 --> 51:29.720
I'll do that one.

51:29.720 --> 51:34.720
Thank you. Thank you for coming and speaking with us again.

51:34.720 --> 51:46.720
At the last meeting, I expressed interest in connecting with students for future. And I'm very excited to hear the piece about the scholarships.

51:46.720 --> 51:56.720
I'm very aware of that program. I'm also hyper aware of how much it costs to go to Marquette. That is where my personal law journey is taking me.

51:56.720 --> 51:58.720
So which I was a golfer.

52:01.720 --> 52:09.720
Also with the restoration, I am a member of the citizens since climate lobby.

52:10.720 --> 52:30.720
My law professor focuses his law interest in environment. So I'm very focused and aware of all of the pros and cons that go into whether or not we address what is happening at shoe park, including the shoreline.

52:30.720 --> 52:56.720
The necessity to replenish our trees and remove the trees that are not healthy right now. I know that it sounds painful, but if people could imagine the one rotten apple in the barrel for analogy, leaving those trees there would have the opposite effect

52:56.720 --> 53:17.720
instead of saving any of our ecosystem or environment, it would have the exact opposite. So I am very happy that you are coming in and donating time and energy and money and putting the family values into that your family has into the shoe park.

53:17.720 --> 53:19.720
Thank you very much.

53:19.720 --> 53:40.720
Thank you. I don't know if you're the right person to answer this. There was a comment that the DNR denied a wetland permit back in November. Is that something you had applied for?

53:50.720 --> 54:04.720
Okay. I'm not aware of it. But again, we will need to get those permits in order for all of this to actually occur.

54:04.720 --> 54:11.720
Okay. Thank you. Any other questions for Mr. Leopold?

54:12.720 --> 54:14.720
Other whites?

54:14.720 --> 54:20.720
I think I know the answer to this, but I just want to ask it because I've had a lot of people mention it.

54:20.720 --> 54:33.720
I'm under the assumption that wind point, Caladonia, those are all going to be received discounts because their drivers license says we're seen. So I'm assuming that's how you would assess a city overseeing resident when they come in to golf.

54:34.720 --> 54:39.720
We will make the determination based on what their driver's license says. Thank you.

54:44.720 --> 54:48.720
Any other questions or comments?

54:48.720 --> 54:55.720
Seeing none, thank you, Mr. Leopold. The other presentations that we've had, or do you want to say anything?

54:55.720 --> 54:56.720
No. Okay.

54:56.720 --> 55:05.720
The other presentations we had in this, we've had Commissioner Rooney present to us twice. He's not here this evening, but he did send out his comments to all of you again today.

55:05.720 --> 55:16.720
He made an assessment about whether or not the proposed plans in his estimate would do the work of protecting the shoreline into the future, which it was his assessment that it is.

55:16.720 --> 55:21.720
We also do have Director Kepnick from Parks, Recreation and Cultural Services here as well.

55:21.720 --> 55:27.720
We can ask him to give an abbreviated presentation regarding the trees and the shoreline.

55:27.720 --> 55:34.720
And again, I think this will be a more abbreviated version because I think some of you have heard this at least once, some of you twice, some of you.

55:34.720 --> 55:43.720
This will be the first time we'll be hearing some of his comments, but if there were additional questions for him regarding that space, you have the ability to ask those questions now.

55:43.720 --> 55:49.720
Mr. Kepnick. Thank you, everyone. As noted, for some of you, this is the fourth time you've heard me.

55:49.720 --> 55:54.720
So I'm kind of recycling the same information, so I'm going to keep it brief.

55:54.720 --> 56:01.720
This is the process that I went through when I first heard about this project so that I could better understand it for my own needs.

56:01.720 --> 56:08.720
The first thing I did was research the area and determined that a wind point in shoe park is, in fact, I recognize birding area.

56:08.720 --> 56:13.720
You heard some information before showing there over 270 species that have been documented in the area.

56:13.720 --> 56:22.720
I also then looked into what type of habitat those birds use and basically broke it down into four major habitat groupings.

56:22.720 --> 56:29.720
There's the open water, the lake habitat, the shoreline beach habitat, open land and metal habitat, and then trees and woodland habitat.

56:29.720 --> 56:38.720
So this was just an acknowledgement that shoreline work won't necessarily impact every type of habitat that's present.

56:38.720 --> 56:49.720
I broke this project down into two pieces, one being that shoreline stabilization and bluff resiliency, and then the golf course redevelopment separately,

56:49.720 --> 56:54.720
because these have different environmental considerations and are for different purposes.

56:54.720 --> 57:06.720
The shoreline bluff work I determined was a resiliency and an infrastructure issue dating back to the January 2020 storm with the record high water levels and a lack of shoreline ice.

57:06.720 --> 57:21.720
There was some bluff damage along the area, entire trees were lost into the lake, and at this point the unstable areas are the damages exacerbating simply due to the fact that the trees are contributing to it rather than preventing it.

57:22.720 --> 57:25.720
The tree and shrub removal along the bluff is tied to the repair work.

57:25.720 --> 57:36.720
Essentially, in order to stabilize the bluff, we need to have access by equipment, there need to be changes made, and trees need to be removed as part of that project.

57:39.720 --> 57:43.720
I then looked into the tree canopy on the course itself.

57:44.720 --> 57:58.720
As the former city forester, I have access to our GIS-based tree inventory consisting of 40,000 public tree sites and all their attributes, so I did a query of the golf course, the trees that are on the golf course.

57:59.720 --> 58:06.720
I determined that the majority of the species are silver maple, green ash, white ash, or we maple and honey locusts.

58:06.720 --> 58:11.720
I take it back actually, 40% of the species are made up of those five.

58:11.720 --> 58:18.720
And then in addition, 55 of 184 trees on the course were under 10 inches in diameter.

58:18.720 --> 58:24.720
That's important because the smaller trees provide less benefit than the large mature trees.

58:25.720 --> 58:32.720
And then lastly, looking at those common trees on the property, several of them do have management and ecological limitations.

58:32.720 --> 58:35.720
Norway maple is one of those species that's present.

58:35.720 --> 58:44.720
It is considered undesirable, recognized by the DNR as a species with invasive tendencies and the ability to spread into natural areas.

58:44.720 --> 58:47.720
Some communities have gone so far as to ban that species.

58:47.720 --> 58:49.720
We have not yet here.

58:50.720 --> 59:06.720
There were the green ash and white ash on the course, and they provided canopy historically, but because they are highly vulnerable to emerald ash borer and they require ongoing pesticide treatment, they do not present long-term habitat.

59:06.720 --> 59:20.720
Silver maple does support a reasonable amount of insect activity compared to some of the other species, but silver maple is a short-lived and prone to decay and storm damage, which limits its long-term reliability.

59:20.720 --> 59:30.720
And then last, honey locust is a native species, but compared to some of the higher value species, it supports relatively low insect diversity.

59:30.720 --> 59:33.720
Any questions for Director Kepnick?

59:34.720 --> 59:36.720
Seeing none, thank you very much.

59:36.720 --> 59:41.720
We now move on to communications introduced to council.

59:41.720 --> 59:47.720
Older land, would you like to make a motion regarding items to be referred to finance and personnel?

59:47.720 --> 59:52.720

Second district.

01:07:01.720 --> 01:07:05.720
There's a motion and a second to refer these items to public safety and licensing.

01:07:05.720 --> 01:07:07.720
All those in favor please say aye.

01:07:07.720 --> 01:07:08.720
Aye.

01:07:08.720 --> 01:07:09.720
Opposed?

01:07:09.720 --> 01:07:11.720
That motion carries.

01:07:11.720 --> 01:07:13.720
Referral to the executive meeting.

01:07:14.720 --> 01:07:17.720
Would you like to make a motion regarding this item?

01:07:17.720 --> 01:07:27.720
Yes, I would move to refer item 0665-26, communications sponsored by Mayor Mason.

01:07:27.720 --> 01:07:32.720
Presenting proposed ordinance 004-26, immigration enforcement.

01:07:32.720 --> 01:07:35.720
So motion and a second to refer this item.

01:07:36.720 --> 01:07:37.720
Thank you.

01:07:37.720 --> 01:07:43.720
I would make a motion to receive and file this communication of ordinance 002-4-26.

01:07:43.720 --> 01:07:44.720
That's it.

01:07:44.720 --> 01:07:49.720
The motion and a second to receive and file this item.

01:07:49.720 --> 01:07:51.720
We've put it straight to the ground.

01:07:51.720 --> 01:07:53.720
There's still about five minutes.

01:07:53.720 --> 01:07:58.720
Kelly, if you can mute your.

01:07:58.720 --> 01:08:03.720
So I will make, I'm sorry, just unmuted and apologize.

01:08:03.720 --> 01:08:05.720
I can't be there.

01:08:05.720 --> 01:08:09.720
I'd like to second that just for discussion sake, please.

01:08:09.720 --> 01:08:12.720
The motion has been seconded to receive and file.

01:08:12.720 --> 01:08:16.720
Just you do have some background noise in the space that you're in.

01:08:16.720 --> 01:08:19.720
So just wanted to let you know that.

01:08:19.720 --> 01:08:23.720
And then we will look for your hand if you want to participate moving forward.

01:08:23.720 --> 01:08:26.720
There's a motion to receive and file this item.

01:08:26.720 --> 01:08:32.720
We will be voting electronically or we will not be voting electronically today.

01:08:32.720 --> 01:08:35.720
So people know all the writing would like to speak further to your motion.

01:08:35.720 --> 01:08:36.720
I would.

01:08:36.720 --> 01:08:37.720
Thank you very much.

01:08:37.720 --> 01:08:40.720
This motion is not a statement about immigration.

01:08:40.720 --> 01:08:47.240
It is a statement about legal exposure, fiscal responsibility and what this body actually

01:08:47.240 --> 01:08:49.800
has the authority to do.

01:08:49.800 --> 01:08:52.240
Start with our own city attorney's memorandum.

01:08:52.240 --> 01:08:59.120
It tells us in writing that enforcement of this ordinance may be limited and that communities

01:08:59.120 --> 01:09:05.120
passing similar measures have done so knowing that they may be unenforceable.

01:09:05.120 --> 01:09:11.520
When our own council recommends approval and that caveat is attached, this council should

01:09:11.520 --> 01:09:15.800
hear it as a warning that it is.

01:09:15.800 --> 01:09:22.360
The Department of Justice has filed 27 lawsuits against more than 20 jurisdictions over ordinances

01:09:22.360 --> 01:09:23.920
like this one.

01:09:23.920 --> 01:09:30.520
In particular section 63-5, the mask provision is precisely the piece being struck down.

01:09:30.520 --> 01:09:37.120
A federal judge black philadelphia's version, the night circuit, black california's, and

01:09:37.120 --> 01:09:42.000
right now 30 miles up the road, Milwaukee is in a standoff with the justice department

01:09:42.000 --> 01:09:48.640
over an identical mask ban, a federal demand letter, a deadline that has already passed

01:09:48.640 --> 01:09:51.440
and a lawsuit almost certainly coming.

01:09:51.440 --> 01:09:55.880
If Milwaukee's ordinance cannot survive, ours won't either.

01:09:55.880 --> 01:09:58.160
We would not be taking a stand.

01:09:58.160 --> 01:10:03.480
We would be joining a fight that already is being lost at our taxpayers expense.

01:10:03.480 --> 01:10:09.280
Second, much of this ordinance regulates business that is not ours.

01:10:09.280 --> 01:10:13.560
Immigration detainers are directed to jails and the city of Racine does not operate a

01:10:13.560 --> 01:10:14.960
jail.

01:10:14.960 --> 01:10:22.640
Any one of our officers arrest is booked into the Racine County Jail under the authority

01:10:22.640 --> 01:10:30.000
of the county sheriff and independently elected constitutional officer over whom this council

01:10:30.000 --> 01:10:32.600
has no power whatsoever.

01:10:32.600 --> 01:10:37.240
The legislature understands this, the bill the governor vetoed the spring targeted county

01:10:37.240 --> 01:10:39.480
sheriff's not city council.

01:10:39.480 --> 01:10:45.360
The detainer provisions before us regulate something that the city does not do.

01:10:45.360 --> 01:10:51.640
The third, what remains largely restates discretion we already have.

01:10:51.640 --> 01:10:57.520
No federal law requires we're seeing to spend its resources on civil immigration enforcement

01:10:57.520 --> 01:10:58.520
today.

01:10:58.520 --> 01:11:04.400
We do not need this ordinance and the litigation that comes with it to keep doing what we already

01:11:04.400 --> 01:11:06.000
are free to do.

01:11:06.000 --> 01:11:11.960
And finally and most importantly, consider what this vote actually asks of us.

01:11:11.960 --> 01:11:20.520
It forces every member of this body and every resident watching into a four or against camp

01:11:20.520 --> 01:11:26.960
on federal immigration policy over provisions that are unenforceable that govern the county's

01:11:26.960 --> 01:11:32.680
business or that changed nothing about how the city operates.

01:11:32.680 --> 01:11:35.800
That is the worst trade a council can make.

01:11:35.800 --> 01:11:39.320
Some division for minimal effect.

01:11:39.320 --> 01:11:45.600
And we make it while facing a projected operational deficit in 2027.

01:11:45.600 --> 01:11:50.880
Receiving and filing accepts this communication into the record, respects the concerns that

01:11:50.880 --> 01:11:56.320
motivated and protects the taxpayers of the city of Racine from paying into litigation

01:11:56.320 --> 01:12:00.040
a question other cities are already losing.

01:12:00.040 --> 01:12:03.400
I ask for your support to receive and file this ordinance.

01:12:03.400 --> 01:12:04.400
Thank you.

01:12:05.400 --> 01:12:11.400
When the clerk calls your name, the motion before you is to receive and file this item,

01:12:11.400 --> 01:12:15.120
if you vote yes, it will receive and file and essentially end moving the item forward.

01:12:15.120 --> 01:12:19.040
If you don't know, it would be referred to the potentially be referred to the executive

01:12:19.040 --> 01:12:20.040
committee.

01:12:20.040 --> 01:12:26.240
When the clerk calls your name, please vote as you wish.

01:12:26.240 --> 01:12:27.240
Elder Kelly.

01:12:27.240 --> 01:12:28.240
Hi.

01:12:28.240 --> 01:12:29.240
Elder Harmon.

01:12:30.240 --> 01:12:31.240
Aye.

01:12:31.240 --> 01:12:32.240
Elder Harmon.

01:12:32.240 --> 01:12:33.240
Elder Pobon.

01:12:33.240 --> 01:12:34.240
Elder Frazier.

01:12:34.240 --> 01:12:35.240
Elder Weiss.

01:12:35.240 --> 01:12:36.240
Elder Davis.

01:12:36.240 --> 01:12:37.240
Elder Mack.

01:12:37.240 --> 01:12:38.240
Elder Durbinson.

01:12:38.240 --> 01:12:39.240
No.

01:12:39.240 --> 01:12:40.240
Elder Weiner.

01:12:40.240 --> 01:12:41.240
Elder Horden.

01:12:41.240 --> 01:12:42.240
No.

01:12:42.240 --> 01:12:43.240
Elder Hodges.

01:12:43.240 --> 01:12:44.240
No.

01:12:44.240 --> 01:12:45.240
Elder Allen.

01:12:45.240 --> 01:12:46.240
No.

01:12:46.240 --> 01:12:47.240
No.

01:12:47.240 --> 01:12:48.240
No.

01:12:48.240 --> 01:12:49.240
No.

01:12:49.740 --> 01:12:51.740
Elder Weiner.

01:12:51.740 --> 01:12:53.740
No.

01:12:53.740 --> 01:12:54.740
Mateo.

01:12:54.740 --> 01:12:55.740
No.

01:12:55.740 --> 01:12:56.240
No.

01:12:56.340 --> 01:12:57.240
No.

01:12:57.240 --> 01:12:58.440
Aldere Harlan.

01:12:58.440 --> 01:12:59.440
No.

01:12:59.440 --> 01:13:00.940
Aldere Enchmann.

01:13:00.940 --> 01:13:01.940
No.

01:13:01.940 --> 01:13:02.940
No.

01:13:02.940 --> 01:13:03.940
onda D.

01:13:03.940 --> 01:13:04.940
Mark.

01:13:04.940 --> 01:13:05.940
No.

01:13:05.940 --> 01:13:11.660
Motion to receive and file fails, but what is now before us is the motion to refer this item

01:13:11.660 --> 01:13:13.480
to the executive committee.

01:13:13.480 --> 01:13:17.360
All those in favor of referring to the executive committee please say aye.

01:13:17.360 --> 01:13:18.320
Opposed?

01:13:18.320 --> 01:13:23.240
the ayes appear to have it we will now move on to committee reports taking the

01:13:23.240 --> 01:13:28.280
unusual step of the executive committee item to the to the front of the calendar

01:13:28.280 --> 01:13:33.400
for action today given the interest on the shoe part issue if other jorgons I

01:13:33.400 --> 01:13:37.000
assume you have at least one request for separate consideration on the items

01:13:37.000 --> 01:13:42.920
before the executive committee today I didn't receive any officially if there's

01:13:42.920 --> 01:13:47.240
anyone who would be requesting it I guess now would be the time and nothing came

01:13:47.240 --> 01:13:51.160
beforehand so I'm seeing all the wider not her head that she'd like separate

01:13:51.160 --> 01:13:57.240
consideration and so if you would read the item for separate consideration which

01:13:57.240 --> 01:13:59.680
one is she requesting

01:13:59.680 --> 01:14:06.160
separate consideration zero six zero nine dash two six zero six zero nine

01:14:06.160 --> 01:14:10.280
dash two six communication sponsored by Mayor Mason requesting to authorize the

01:14:10.280 --> 01:14:14.040
mayor and city clerk to enter into an agreement with Leopold Johnson Gulf

01:14:14.040 --> 01:14:19.080
group for shoreline stabilization habitat restoration clubhouse construction

01:14:19.080 --> 01:14:24.400
and a long-term lease for the operation and meetings of shoe park the recommendation

01:14:24.400 --> 01:14:29.340
from the executive committee was to approve is there a second from Alderman

01:14:29.340 --> 01:14:33.800
bone all the jurgons would you like to speak to the notion yeah I mean it was

01:14:33.800 --> 01:14:41.960
very very lengthy meeting so I won't try to rehash everything from it but since

01:14:41.960 --> 01:14:44.760
we're pulling it out for separate consideration it's been something that

01:14:44.760 --> 01:14:50.360
I've had many many discussions with residents on I've had many discussions

01:14:50.360 --> 01:14:56.040
with non-residents quite a few of them as well and one thing that I think is

01:14:56.040 --> 01:15:01.560
really coming through with this is it's really not perfect for anybody one of

01:15:01.560 --> 01:15:09.520
the comments that was made in the in committee actually by Mr. Leopold was

01:15:09.600 --> 01:15:13.760
that he wasn't super thrilled that it was tied to a course that he didn't own

01:15:13.760 --> 01:15:19.960
or manage the rates for and that would be putting it out of their control it

01:15:19.960 --> 01:15:23.400
made him a little uncomfortable I know there's some city residents who are

01:15:23.400 --> 01:15:28.240
uncomfortable with this moving forward however when you really boil it down to

01:15:28.240 --> 01:15:34.520
what it is is this is an opportunity to get out of the hole that's been dug here

01:15:34.600 --> 01:15:41.400
the clubhouse is in desperate need of replacement we continue to hear over

01:15:41.400 --> 01:15:45.600
and over and over again of things that aren't working the irrigation system I

01:15:45.600 --> 01:15:48.880
received an email today from someone who worked there who wanted to tell me

01:15:48.880 --> 01:15:52.800
that they're currently hand watering large portions of the course to keep it

01:15:52.800 --> 01:15:58.800
going as you can imagine that's probably not the most sustainable practice for a

01:15:58.840 --> 01:16:05.120
golf course he went on and on about how all of the things of him working there

01:16:05.120 --> 01:16:08.640
and being there for many years has led to him being in favor of it he had just

01:16:08.640 --> 01:16:13.560
shared some concerns that he had but he had full trust in the Leopold Johnson

01:16:13.560 --> 01:16:18.000
group to do what they say they're going to do and make sure that it's truly a

01:16:18.000 --> 01:16:23.280
gem for the community and I believe that they've really earned that trust they've

01:16:23.280 --> 01:16:28.520
done many projects in the community it's okay to be nervous and it's okay to want

01:16:28.520 --> 01:16:31.360
to make sure that we hold them accountable to it and we've heard tonight

01:16:31.360 --> 01:16:34.520
that they they welcome that accountability that they know what they're

01:16:34.520 --> 01:16:37.520
getting into they want to make sure that what they're doing is going to be

01:16:37.520 --> 01:16:44.280
right because if we do nothing that's the most important part I think if we do

01:16:44.280 --> 01:16:52.440
nothing we're going to lose large portions of it we received a report in

01:16:52.440 --> 01:16:57.360
2020 detailing that the question raised was raised tonight of why didn't we do

01:16:57.440 --> 01:17:02.560
this before why wasn't this done previously why wasn't their discussion on

01:17:02.560 --> 01:17:06.720
it there was it maybe didn't reach the level of media attention that this has

01:17:06.720 --> 01:17:10.680
but there was a report that was done we received information that if we don't

01:17:10.680 --> 01:17:15.960
do bluff stabilization that the bluff is potentially going to fall into the lake

01:17:15.960 --> 01:17:21.960
and so the idea that there's nothing that we could do if we just sit tight the

01:17:21.960 --> 01:17:25.260
further that goes along we actually at one of the other things that I think is

01:17:25.260 --> 01:17:28.900
important is our city forester and director of parks or former city

01:17:28.900 --> 01:17:33.500
forester excuse me and director of parks made the comment that it's been brought

01:17:33.500 --> 01:17:37.740
up about doing a living shoreline but the erosion has progressed so far at this

01:17:37.740 --> 01:17:42.260
point that that really isn't an option for the vast majority of it and I fear

01:17:42.260 --> 01:17:46.980
that if we continue to do nothing how much more will be lost or how much more

01:17:46.980 --> 01:17:51.060
of a drastic option are we going to have to do in the future as it continues to

01:17:51.060 --> 01:17:56.940
deteriorate because the other question that's been brought up is if we do you

01:17:56.940 --> 01:17:59.940
know maybe we vote this down and we'll fund it somewhere else I can confidently

01:17:59.940 --> 01:18:05.500
say the city does not have money to fund this ourselves and this is something

01:18:05.500 --> 01:18:10.700
that I also can't imagine being that we hear all the time about the cost of

01:18:10.700 --> 01:18:16.060
property taxes can't imagine that the average resident is okay with funding

01:18:16.060 --> 01:18:20.500
this through property tax increases to repair a park that's not even in the

01:18:20.500 --> 01:18:27.500
city limits so all of that's to say before before us today is an opportunity

01:18:27.500 --> 01:18:31.860
to really start a partnership on moving this part forward there's going to be

01:18:31.860 --> 01:18:37.300
many many conversations in the future about the Huyapodown society with the

01:18:37.300 --> 01:18:42.500
Leopold-Johnson's and others to make sure that this truly works for everybody we

01:18:42.500 --> 01:18:46.620
heard it tonight everyone's got to see at the table on this around the trees and

01:18:46.660 --> 01:18:53.580
the birds and so I really view that this is something that in the future really

01:18:53.580 --> 01:18:59.100
has the opportunity to truly define our area and what we want it to be known

01:18:59.100 --> 01:19:03.460
as the last thing I'll leave you with on where I got to here because it was no

01:19:03.460 --> 01:19:08.580
easy decision to make for me was I got the thinking of bringing my daughter to

01:19:08.580 --> 01:19:13.220
this park and what do I want to show what that I did on my time on the

01:19:13.220 --> 01:19:17.620
council why I want to show her where there used to be a clubhouse but we did

01:19:17.620 --> 01:19:21.620
nothing in a deteriorated and it's gone and there's no clubhouse there now do I

01:19:21.620 --> 01:19:27.940
want to bring her to a potential mudslides spot where there used to be a

01:19:27.940 --> 01:19:31.780
bluff here used to be able to walk out close to the lake that's all gone now

01:19:31.780 --> 01:19:37.580
there's no there's no longer a bluff there I want to bring her to areas on the

01:19:37.580 --> 01:19:41.620
beach where you can't really access them anymore because so many down trees have

01:19:41.660 --> 01:19:48.900
continued to pile up it's inaccessible or do I want to bring her to a place that

01:19:48.900 --> 01:19:53.380
as we've heard tonight clubhouse is welcome to anybody grab a cup of coffee

01:19:53.380 --> 01:19:56.780
come out there and set at the picnic tables enjoy the lake shore go to the

01:19:56.780 --> 01:20:00.900
new public beach that is totally public open to everybody that sounds like

01:20:00.900 --> 01:20:09.100
potential kayak launch point now as well go along the new walking trail I think

01:20:09.100 --> 01:20:12.740
that's the future that I want to have when I bring my daughter of what we did

01:20:12.740 --> 01:20:17.860
on the council together it's an opportunity for for growth and redevelopment

01:20:17.860 --> 01:20:23.700
and preservation as opposed to getting caught up in how it used to be or what

01:20:23.700 --> 01:20:27.620
it should have been which results in a lot of these things haven't deteriorated

01:20:27.620 --> 01:20:32.140
beyond repair and so I think this is our opportunity tonight to move start

01:20:32.140 --> 01:20:37.700
forward and and go along the long track of repairing and restoring this beautiful

01:20:37.700 --> 01:20:41.100
area. Thank you.

01:20:41.100 --> 01:20:47.460
Thank you. I asked that this item be pulled out for separate consideration

01:20:47.460 --> 01:20:52.500
because I thought about the courage that it took for the board members in

01:20:52.500 --> 01:21:01.700
windpoint to make a unanimous public vote on this agreement this arrangement and I

01:21:01.700 --> 01:21:07.340
think that we this city council should have the opportunity to have our voices

01:21:07.340 --> 01:21:16.820
be heard by watch it's tithing me our voices be heard in our vote when we

01:21:16.820 --> 01:21:21.660
vote on this item I thought it was much worthy not just being passed along to

01:21:21.660 --> 01:21:25.780
the consent agenda rather a separate vote and I also want to take an

01:21:25.780 --> 01:21:30.860
opportunity to think that Leopold Johnson family for their generous generous

01:21:30.860 --> 01:21:36.700
offer to replenish our beloved shoe park and a golf course out there and

01:21:36.700 --> 01:21:43.260
having spent over 50 years out in that area I know how much it needs the work

01:21:43.260 --> 01:21:48.900
to be done and I know that we have not had the resources to put into it and we

01:21:48.900 --> 01:21:54.220
appreciate the gift that you are giving the city receipt we also appreciate and

01:21:54.220 --> 01:21:59.300
want to thank you for your very generous gift of 1.9 million as a

01:21:59.300 --> 01:22:04.420
contribution toward the Lincoln King Center and the annual gift of $25,000

01:22:04.420 --> 01:22:09.340
it was very very generous for you to offer to do that for the city ever seen

01:22:09.340 --> 01:22:15.740
and we are very grateful for that and I want the opportunity to say that so that

01:22:15.740 --> 01:22:21.580
is the reason why this called up so we can vote separate on this item and show

01:22:21.580 --> 01:22:27.500
our support for this generous gift we have two other members in the queue I do

01:22:27.500 --> 01:22:33.260
know we we did have several people ask the city attorney to make comment on

01:22:33.260 --> 01:22:39.660
whether or not this having a golf course was in in accordance with the deed that

01:22:39.660 --> 01:22:44.020
we received from Mr. Shoop more than a century ago I'd have a golf course on

01:22:44.020 --> 01:22:48.020
that space so if it unless there are any objections I'll ask the city attorney

01:22:48.020 --> 01:22:52.500
to to render that opinion now just for information as we move into the

01:22:52.500 --> 01:22:59.460
conversation thank you Mr. Mayor I'm addressing the specific part of Dr.

01:22:59.460 --> 01:23:05.940
Shoop's deed that requires that the property shelf forever be held maintained

01:23:05.940 --> 01:23:11.940
and improved by the city for public park purposes so the issue is not really

01:23:11.940 --> 01:23:15.460
whether shoe park would continue to remain a public park of course it would

01:23:15.460 --> 01:23:20.700
the real question is whether a publicly accessible municipal golf course is a

01:23:20.740 --> 01:23:25.980
legitimate public park use and in my opinion based upon the law the answer

01:23:25.980 --> 01:23:32.620
clearly is yes ultimately though whether the proposed use is a legitimate public

01:23:32.620 --> 01:23:37.060
park use is the decision for the common council and only the common council to

01:23:37.060 --> 01:23:41.620
make for nearly 100 years shoe park has included a golf course throughout that

01:23:41.620 --> 01:23:47.140
time the property has remained a public park owned by the city of Racine this

01:23:47.140 --> 01:23:51.380
proposal does not change that fundamental character it does not sell

01:23:51.380 --> 01:23:55.900
the land it does not remove the land from the park system it does not convert the

01:23:55.900 --> 01:24:00.660
property into a private country club it continues a long-standing public

01:24:00.660 --> 01:24:05.180
recreational use while creating an opportunity to improve improve the

01:24:05.180 --> 01:24:10.180
facility through private investment rather than taxpayer dollars Wisconsin

01:24:10.180 --> 01:24:15.300
law has long recognized that municipalities may acquire develop maintain

01:24:15.340 --> 01:24:19.660
and improve parks and recreational facilities for the benefit of their

01:24:19.660 --> 01:24:24.540
residents our statutes do not treat recreation as something separate from

01:24:24.540 --> 01:24:30.660
park purposes recreation is one of the principal reasons parks exist that has

01:24:30.660 --> 01:24:35.380
that understanding is guided Wisconsin municipalities for many generations

01:24:35.380 --> 01:24:39.660
courts and other Midwestern states have reached the same conclusion they

01:24:39.660 --> 01:24:44.740
recognized that public park purposes are not limited to passive green space but

01:24:44.780 --> 01:24:49.140
include facilities devoted to public recreation including municipal golf

01:24:49.140 --> 01:24:53.500
courses as one court observed the public golf course serves the same public

01:24:53.500 --> 01:24:58.100
recreational purpose as other park facilities another recognized that

01:24:58.100 --> 01:25:02.860
municipalities may include golf courses within public parks because they provide

01:25:02.860 --> 01:25:07.740
recreational opportunities for the public that reasoning is entirely

01:25:07.740 --> 01:25:14.140
consistent with how parks have developed in Wisconsin the Racine the Racine

01:25:14.180 --> 01:25:18.300
Park system also reflects that understanding Racine's parks contain

01:25:18.300 --> 01:25:22.900
baseball diamonds football field soccer fields basketball courts tennis courts

01:25:22.900 --> 01:25:28.700
pickleball courts in 1800 foot a square foot skate park splash pad dog parks

01:25:28.700 --> 01:25:33.540
and two other golf courses every one of those facilities occupies parkland

01:25:33.540 --> 01:25:38.980
everyone is designed for a particular recreational activity I'd recommend

01:25:38.980 --> 01:25:43.140
that you set aside any argument that some people make that this proposal that

01:25:43.140 --> 01:25:47.300
opponents of this proposal will seek redress from the attorney general or the

01:25:47.300 --> 01:25:52.460
courts it's my opinion that any such claim would not be successful some of

01:25:52.460 --> 01:25:57.300
express concerns this proposal somehow privatizes shoe park respectfully I

01:25:57.300 --> 01:26:03.140
characterize find that characterization inaccurate municipalities routinely

01:26:03.140 --> 01:26:06.980
contract with private entities to operate public facilities throughout

01:26:06.980 --> 01:26:11.420
Wisconsin across the country and in the city Racine private companies manage

01:26:11.460 --> 01:26:16.100
concession stands campgrounds restaurants municipal golf courses located on

01:26:16.100 --> 01:26:20.780
public land contracting for professional management does not transfer ownership

01:26:20.780 --> 01:26:25.940
or alter the public character of the property the city retains title the city

01:26:25.940 --> 01:26:29.980
establishes the terms the lease the city of restraint retains oversight and

01:26:29.980 --> 01:26:35.180
enforcement authority and most importantly the land continues to serve the

01:26:35.180 --> 01:26:40.780
public the city will continue to own shoe park the golf course will remain open to

01:26:40.780 --> 01:26:44.500
every member of the public it will not become a private club it will not be

01:26:44.500 --> 01:26:49.700
restricted to members or invited guests Racine residents will receive discounted

01:26:49.700 --> 01:26:56.020
green fees reinforcing this is a city municipal recreational facility intended

01:26:56.020 --> 01:27:01.260
to benefit the community any claim that resident discounts violate the concept

01:27:01.260 --> 01:27:06.500
of a public park is plainly incorrect municipal resident non-resident fee

01:27:06.500 --> 01:27:10.420
differentials are common throughout Wisconsin and nationally frankly this

01:27:10.420 --> 01:27:15.140
common council in its annual budget has approved differing fees for residents and

01:27:15.140 --> 01:27:20.580
non-residents for kickball softball pickleball basketball boat launch soccer and

01:27:20.580 --> 01:27:25.220
baseball field rental and the purchase of graves among other things the operator

01:27:25.220 --> 01:27:29.660
will redesign and improve the course at its own expense and then manage it on the

01:27:29.660 --> 01:27:34.780
city's behalf much as a private management company has done for years

01:27:35.060 --> 01:27:40.140
shoe park will remain a public park called shoe park it's golf course will remain a

01:27:40.140 --> 01:27:44.540
public course the public will continue to join the property just as it has for

01:27:44.540 --> 01:27:48.860
nearly a century this proposal preserves that tradition while improving the

01:27:48.860 --> 01:27:54.300
facility in my judgment that is entirely consistent with the concept of public

01:27:54.300 --> 01:27:59.180
park purposes and with the city's long-standing stewardship of one of her

01:27:59.180 --> 01:28:04.900
scenes most treasured public spaces as a matter of public policy whether to

01:28:04.900 --> 01:28:09.220
accept this proposal it's an issue for the common council as a legal issue and

01:28:09.220 --> 01:28:12.660
38 years of practicing law more than half of which has been represented the

01:28:12.660 --> 01:28:17.300
city of Racine I've rarely seen a clearer case approving this proposal is

01:28:17.300 --> 01:28:22.920
consistent with Dr. Shubes gift to the city thank you all the

01:28:22.920 --> 01:28:29.960
people thank you Mr. Mayor so I've heard a lot had a lot of constituents we

01:28:29.960 --> 01:28:34.560
tell both for and against and I've heard a lot of the issues but I've also heard

01:28:34.560 --> 01:28:40.440
a lot of those issues addressed here Forrester has indicated that what is

01:28:40.440 --> 01:28:45.360
currently there is not conducive to keeping said things there erosion means

01:28:45.360 --> 01:28:50.200
to erode so means goes away so if we do nothing like we have been for the past

01:28:50.360 --> 01:28:54.960
longer than I've been alive it's going to continue to do what it's doing so this

01:28:54.960 --> 01:29:01.120
plan gives us a path an opportunity forward without having the city taxpayers

01:29:01.120 --> 01:29:04.800
be on the on the dime for that because we've we've seen that we've we spend

01:29:04.800 --> 01:29:09.440
what $100,000 a year currently to maintain that area is that enough it won't it

01:29:09.440 --> 01:29:12.480
will never be enough because we don't have the money to redo the

01:29:12.480 --> 01:29:16.200
infrastructure that's there we don't have the money to stabilize the shoreline we

01:29:16.200 --> 01:29:19.480
don't have the money to maintain the park and anyone who's played that can tell

01:29:19.520 --> 01:29:27.680
you it is there is something to be said because you know the Johnson family has

01:29:27.680 --> 01:29:32.680
been in this community forever generations upon generations upon

01:29:32.680 --> 01:29:37.240
generations and for them to partner with Leopold group and to come to the city

01:29:37.240 --> 01:29:42.440
when they could have gone to Kaudou and Yomawaki Oak Creek anywhere else really

01:29:42.440 --> 01:29:46.800
and said hey well you want ten million dollars we'll give you ten million

01:29:46.800 --> 01:29:51.000
dollars to do this they decided to do that here just like they have their

01:29:51.000 --> 01:29:54.760
world headquarters for their company here just like they've invested throughout

01:29:54.760 --> 01:30:01.160
the centuries yeah centuries here so when they come to you and they say hey we'll

01:30:01.160 --> 01:30:05.720
give you ten million dollars we're gonna do it we'll do this here we'll also give

01:30:05.720 --> 01:30:09.000
you another one time one plus million dollars for your Lincoln King Center and

01:30:09.000 --> 01:30:12.880
then we'll give you twenty five thousand dollars a year toward that purpose over

01:30:12.880 --> 01:30:16.720
the course of 50 years it's one other one point two five million dollars I don't

01:30:16.720 --> 01:30:20.000
have that I don't have that lying in my couch or anything I mean I know we get a

01:30:20.000 --> 01:30:25.160
wealthy salary here as as elders but none of us have that but for them to think

01:30:25.160 --> 01:30:29.360
about hey you know what this is an issue how could we fix this but one of the key

01:30:29.360 --> 01:30:35.360
things here I think people need to just give more light to an understand is that

01:30:35.360 --> 01:30:41.080
they have been receptive they have helpless and in sessions they have come

01:30:41.080 --> 01:30:44.600
before this council before different committees several times all open to the

01:30:44.600 --> 01:30:51.520
public to receive input and they're gonna continue to do that just like they have

01:30:51.520 --> 01:30:58.440
for all of ever for the city so I think there are a lot of concerns that were

01:30:58.440 --> 01:31:04.600
raised but that would be exacerbated by doing nothing and continuing it to let

01:31:04.600 --> 01:31:09.360
it be what it is now and so we we also have to it's not about it they're not

01:31:09.520 --> 01:31:15.120
out of town developers that are coming in from Madison or Utah or somewhere you

01:31:15.120 --> 01:31:18.800
know they they have their roots here they've proven their commitment to the

01:31:18.800 --> 01:31:22.920
community and I think that should be worth something so I am in favor of this

01:31:22.920 --> 01:31:32.160
motion thank you thank you as in the executive committee meeting I find

01:31:32.160 --> 01:31:39.080
myself coming behind some excellent comments from my fellow colleagues so

01:31:39.080 --> 01:31:44.680
I'll keep it brief and say that after I was out at the park this past Sunday

01:31:44.680 --> 01:31:54.440
and I saw for myself firsthand and I want to thank the Johnson group for making

01:31:54.440 --> 01:32:00.680
the offer I will be supporting it but as the speakers before me already pointed

01:32:00.680 --> 01:32:07.400
out the pros outweigh the cons where or we're going to just take a negative

01:32:07.400 --> 01:32:13.920
side up perspective and leave it do nothing or we're gonna move forward but

01:32:13.920 --> 01:32:18.040
more but on the other side of that I took an opportunity to speak to some of

01:32:18.040 --> 01:32:24.360
the parkers and they expressed most of the same sentiments that we've heard

01:32:24.360 --> 01:32:29.080
here tonight as well as at the executive committee meeting and I feel confident

01:32:29.080 --> 01:32:36.800
that those questions and concerns will be addressed and that as we move forward

01:32:36.800 --> 01:32:42.320
I think we're doing a bit making a decision if we are you like to go

01:32:42.320 --> 01:32:50.640
up accept that I think we've given a gift for generations to come thank you

01:32:50.880 --> 01:32:54.680
there are no other members of the council in the queue to speak on this

01:32:54.680 --> 01:33:01.160
item when the clerk calls your name please vote as you wish

01:33:01.160 --> 01:33:05.600
Elder Kelly yes

01:33:05.600 --> 01:33:07.160
Elder Harmon

01:33:07.160 --> 01:33:08.160
Yes

01:33:08.160 --> 01:33:09.160
Elder Poem

01:33:09.160 --> 01:33:11.160
Elder Frazier

01:33:11.160 --> 01:33:13.160
Elder Wise

01:33:13.160 --> 01:33:14.160
Elder Davis

01:33:14.160 --> 01:33:16.160
Elder Mack

01:33:16.160 --> 01:33:18.160
Elder Jorgensen

01:33:18.160 --> 01:33:19.160
Elder Weiner

01:33:19.160 --> 01:33:21.160
Elder Horton

01:33:21.160 --> 01:33:22.160
Elder Hodges

01:33:22.160 --> 01:33:24.160
Elder Allen

01:33:24.160 --> 01:33:25.160
Elder Pea

01:33:25.160 --> 01:33:26.160
Elder Lan

01:33:26.160 --> 01:33:28.160
Elder Demer

01:33:28.160 --> 01:33:35.160
There are 15 ayes and zero nos it is passed unanimously

01:33:35.160 --> 01:33:51.160
Moving on to finance and personnel

01:33:51.160 --> 01:33:52.160
Elder Lan

01:33:52.160 --> 01:33:54.160
Do you have any items for separate consideration?

01:33:54.160 --> 01:33:56.160
Yes

01:33:56.160 --> 01:33:59.160
I have one item

01:34:00.160 --> 01:34:04.160
Item 0610-26

01:34:04.160 --> 01:34:07.160
Communications sponsored by myself

01:34:07.160 --> 01:34:13.160
Requesting approval to enter into a three-year contract with passport labs

01:34:13.160 --> 01:34:18.160
to move away from the old coin meters and transition to a fully

01:34:18.160 --> 01:34:22.160
digital platform for parking payments and enforcement

01:34:22.160 --> 01:34:26.160
The recommendation of the committee was at the mayor and city clerk

01:34:26.160 --> 01:34:31.160
Be authorized to execute and sign the contract with passport labs

01:34:31.160 --> 01:34:34.160
aimed to implement and maintain their system

01:34:34.160 --> 01:34:43.160
Fiscal note this is a three-year contract with the total cost of $24,255 for implementation

01:34:43.160 --> 01:34:49.160
This includes a one-time cost of $12,255 for hardware and equipment

01:34:49.160 --> 01:34:54.160
and a $12,000 annually for system licensing

01:34:54.160 --> 01:35:03.160
The funds are available and MIS account 70113-57800 for fiscal year 2026

01:35:03.160 --> 01:35:07.160
and recurring system licensing for subsequent years

01:35:07.160 --> 01:35:11.160
will be appropriated during the annual budget processes

01:35:11.160 --> 01:35:13.160
Move to approve

01:35:13.160 --> 01:35:18.160
There's a motion and a second to approve this item

01:35:18.160 --> 01:35:23.160
Mr. Frazier, did you want to make a motion regarding this item?

01:35:23.160 --> 01:35:26.160
Yes

01:35:26.160 --> 01:35:31.160
Why don't we just hold for just one minute to let the enthusiasm in the hallway move down

01:35:31.160 --> 01:35:35.160
just a little bit so we can hear not only what's in the chamber

01:35:35.160 --> 01:35:40.160
and not what's outside the chamber

01:35:40.160 --> 01:35:42.160
All the Frazier, please continue

01:35:42.160 --> 01:35:48.160
I'd like to make a motion to refer this back to the committee

01:35:48.160 --> 01:35:52.160
There's a motion to refer this item back to finance and personnel

01:35:52.160 --> 01:35:57.160
Is there a second on referring the item back? All their winders

01:35:57.160 --> 01:36:00.160
All their Frazier, would you like to speak to your motion to refer back to committee?

01:36:00.160 --> 01:36:04.160
Yes, so I'm not against this

01:36:04.160 --> 01:36:08.160
I think that there are some outstanding questions

01:36:08.160 --> 01:36:11.160
that have to be answered

01:36:11.160 --> 01:36:15.160
I've met with my business owners in my district

01:36:15.160 --> 01:36:18.160
over the last three weeks that I've been back

01:36:18.160 --> 01:36:23.160
and they've expressed concerns about how this would be implemented

01:36:23.160 --> 01:36:26.160
where I think the bigger question is going to be

01:36:26.160 --> 01:36:28.160
where are these going to be placed

01:36:28.160 --> 01:36:32.160
Several business owners express concerns of elderly people

01:36:32.160 --> 01:36:36.160
not being able to use these systems

01:36:36.160 --> 01:36:38.160
namely an app

01:36:38.160 --> 01:36:40.160
so what's the work around for that?

01:36:40.160 --> 01:36:42.160
The location of these

01:36:42.160 --> 01:36:47.160
I have no to call them the boxes for people to use

01:36:47.160 --> 01:36:50.160
and some other questions

01:36:50.160 --> 01:36:55.160
but I think sending this back to the committee allows those questions to be answered

01:36:55.160 --> 01:36:58.160
It allows some of my business owners in the downtown area

01:36:58.160 --> 01:37:01.160
who this pretty much affects

01:37:01.160 --> 01:37:03.160
to come to the meeting

01:37:03.160 --> 01:37:07.160
and really voice their concerns to see if some answers can be

01:37:07.160 --> 01:37:11.160
to see if answers to their questions will be had

01:37:11.160 --> 01:37:13.160
so that's my motion

01:37:13.160 --> 01:37:15.160
otherwise

01:37:15.160 --> 01:37:19.160
Thank you, I do have a question for the police chief

01:37:19.160 --> 01:37:23.160
I support this motion but I'm also wondering if this should

01:37:23.160 --> 01:37:27.160
also go to public works and services committee

01:37:27.160 --> 01:37:31.160
because of some of the comments that

01:37:31.160 --> 01:37:35.160
from the discussion that I had with the police chief

01:37:35.160 --> 01:37:39.160
If you could state your question

01:37:39.160 --> 01:37:42.160
we'll ask the police chief to approach the DS

01:37:42.160 --> 01:37:46.160
I would just point out we are in the midst of a motion to refer the item back

01:37:46.160 --> 01:37:50.160
not to debate the item so if it's a procedural question on that

01:37:50.160 --> 01:37:53.160
I think that would be fine but I think what we have before us

01:37:53.160 --> 01:37:55.160
is a motion to refer the item back

01:37:55.160 --> 01:37:57.160
Chief Ramirez

01:37:57.160 --> 01:37:59.160
Good morning

01:37:59.160 --> 01:38:01.160
Good question is

01:38:01.160 --> 01:38:03.160
It's a little bit afternoon

01:38:03.160 --> 01:38:05.160
Good afternoon, sorry

01:38:05.160 --> 01:38:07.160
I'm here all the time so it doesn't matter

01:38:07.160 --> 01:38:09.160
The question is

01:38:09.160 --> 01:38:12.160
this was referred by you to finance committee

01:38:12.160 --> 01:38:16.160
because of what your role will be in this

01:38:16.160 --> 01:38:20.160
but there's also another role to this project

01:38:20.160 --> 01:38:22.160
that falls under another department

01:38:22.160 --> 01:38:23.160
are am I incorrect?

01:38:23.160 --> 01:38:24.160
That's correct

01:38:24.160 --> 01:38:26.160
My role is the parking enforcement piece

01:38:26.160 --> 01:38:28.160
It's a software upgrade for us

01:38:28.160 --> 01:38:32.160
There's any changes to the citation procedure

01:38:32.160 --> 01:38:34.160
where this court time changes things like that for us

01:38:34.160 --> 01:38:36.160
It's a software upgrade for us

01:38:36.160 --> 01:38:39.160
Whether there are kiosks, apps

01:38:39.160 --> 01:38:41.160
that falls on a different department

01:38:41.160 --> 01:38:44.160
So I think what the concern is

01:38:44.160 --> 01:38:47.160
is moving away from the parking meters

01:38:47.160 --> 01:38:49.160
to just an app or kiosk

01:38:49.160 --> 01:38:52.160
is creating some angst for individuals

01:38:52.160 --> 01:38:55.160
So I would ask you, Chief, is it appropriate for this

01:38:55.160 --> 01:38:57.160
to go back to the finance committee

01:38:57.160 --> 01:39:00.160
or should it possibly go to public works?

01:39:00.160 --> 01:39:03.160
I would leave that up to the council member here

01:39:03.160 --> 01:39:05.160
which committee goes to

01:39:05.160 --> 01:39:07.160
but for us it's a software upgrade

01:39:07.160 --> 01:39:09.160
on the parking enforcement piece

01:39:09.160 --> 01:39:11.160
whether how it gets paid

01:39:11.160 --> 01:39:13.160
whether it's through a kiosk, QR code

01:39:13.160 --> 01:39:15.160
kiosks, I may accept coins

01:39:15.160 --> 01:39:19.160
I think a question for the other department to answer

01:39:19.160 --> 01:39:21.160
If you'd like to refer your question

01:39:21.160 --> 01:39:23.160
to the finance director

01:39:23.160 --> 01:39:25.160
we could potentially ask it again

01:39:25.160 --> 01:39:27.160
but again referrals typically done

01:39:27.160 --> 01:39:29.160
for a number of reasons

01:39:29.160 --> 01:39:31.160
particularly contracts that we enter into

01:39:31.160 --> 01:39:33.160
and the financial impact of it

01:39:33.160 --> 01:39:37.160
Yes, thank you for that

01:39:37.160 --> 01:39:40.160
I think it's a very valid question

01:39:40.160 --> 01:39:43.160
I just want to clarify a couple of things

01:39:43.160 --> 01:39:48.160
So the changes associated with the public work side of this

01:39:48.160 --> 01:39:51.160
and kiosk and ABM

01:39:51.160 --> 01:39:54.160
and going away from parking meters

01:39:54.160 --> 01:39:57.160
that actually went to public works and services

01:39:57.160 --> 01:39:59.160
in the fall of 2025

01:39:59.160 --> 01:40:01.160
so in October of 2025

01:40:01.160 --> 01:40:05.160
this common council approved a change in that process

01:40:05.160 --> 01:40:10.160
it was actually under item 0924-25

01:40:10.160 --> 01:40:13.160
but having said that the Chief was absolutely right

01:40:13.160 --> 01:40:14.160
in what he said

01:40:14.160 --> 01:40:17.160
what's before you tonight in finance and personnel

01:40:17.160 --> 01:40:19.160
is just a software upgrade

01:40:19.160 --> 01:40:22.160
we already use passport as a software

01:40:22.160 --> 01:40:24.160
as you see out in the community

01:40:24.160 --> 01:40:28.160
this is a software upgrade to allow the police department

01:40:28.160 --> 01:40:32.160
to use that software versus what was a homeroom software

01:40:32.160 --> 01:40:37.160
for enforcement so that we're using the same software city wide

01:40:37.160 --> 01:40:41.160
that's why it went to finance and personnel for this particular thing

01:40:41.160 --> 01:40:45.160
the operational piece of kiosks, no kiosks

01:40:45.160 --> 01:40:49.160
that type of thing that would be more public works

01:40:49.160 --> 01:40:51.160
in the implementation of the program

01:40:51.160 --> 01:40:53.160
thank you for that

01:40:53.160 --> 01:40:55.160
and that clarifies things a lot

01:40:55.160 --> 01:40:57.160
so I would ask the maker of the motion

01:40:57.160 --> 01:41:01.160
if he would consider withdrawing the motion

01:41:01.160 --> 01:41:05.160
and submitting a separate motion

01:41:05.160 --> 01:41:08.160
it does

01:41:08.160 --> 01:41:11.160
yes

01:41:11.160 --> 01:41:15.160
yes

01:41:15.160 --> 01:41:19.160
I don't know that you can amend the motion before us to a joint referral

01:41:19.160 --> 01:41:22.160
I think you'd have to make this motion first

01:41:22.160 --> 01:41:25.160
and then if it failed you can make a subsequent motion after it

01:41:25.160 --> 01:41:28.160
but what we have right now is an item for referral

01:41:28.160 --> 01:41:30.160
to a particular committee

01:41:30.160 --> 01:41:33.160
otherwise you have the floor

01:41:33.160 --> 01:41:34.160
thank you

01:41:34.160 --> 01:41:36.160
so I would withdraw my second

01:41:36.160 --> 01:41:38.160
can I withdraw my second?

01:41:39.160 --> 01:41:43.160
I don't believe that you can withdraw my second

01:41:43.160 --> 01:41:47.160
well then I'm going to speak against the motion that I seconded

01:41:47.160 --> 01:41:50.160
and the reason for that I think the appropriate action would be

01:41:50.160 --> 01:41:53.160
is to vote down setting this back to finance

01:41:53.160 --> 01:41:56.160
for the reasons that were stated by the chief of police

01:41:56.160 --> 01:41:58.160
and our finance director

01:41:58.160 --> 01:42:01.160
and then later have a separate communication

01:42:01.160 --> 01:42:04.160
to the public works committee in regards to the concerns

01:42:04.160 --> 01:42:07.160
that many of us had heard from people

01:42:07.160 --> 01:42:10.160
in regards to how are they going to pay for their parking?

01:42:12.160 --> 01:42:14.160
all their drugs

01:42:14.160 --> 01:42:16.160
so

01:42:16.160 --> 01:42:19.160
I'm failing to understand why we wouldn't want to

01:42:19.160 --> 01:42:21.160
if there's questions on the item

01:42:21.160 --> 01:42:25.160
the item itself is specific to finance and personnel

01:42:25.160 --> 01:42:27.160
if we want to talk about the operation of it

01:42:27.160 --> 01:42:29.160
it was mentioned tonight of

01:42:29.160 --> 01:42:31.160
maybe we do a separate item

01:42:31.160 --> 01:42:32.160
you can do both

01:42:32.160 --> 01:42:35.160
you can put in a communication to talk about the operation component of it

01:42:35.160 --> 01:42:38.160
but the software upgrade piece to it

01:42:38.160 --> 01:42:41.160
does have financial implications behind it

01:42:41.160 --> 01:42:44.160
so you can move this forward

01:42:44.160 --> 01:42:46.160
you can send it back

01:42:46.160 --> 01:42:48.160
I'm in favor of sending it back

01:42:48.160 --> 01:42:50.160
if the alder from the first

01:42:50.160 --> 01:42:52.160
I received an email from one of his

01:42:52.160 --> 01:42:54.160
a business owner in his community

01:42:54.160 --> 01:42:57.160
they were not able to come to the first meeting

01:42:57.160 --> 01:42:59.160
if there's additional comments

01:42:59.160 --> 01:43:02.160
that would like to be made at a finance and personnel community

01:43:02.160 --> 01:43:04.160
to discuss it there

01:43:04.160 --> 01:43:06.160
around this specific item

01:43:06.160 --> 01:43:10.160
I think that's more than a good place to do it

01:43:10.160 --> 01:43:14.160
there was one resident that did come and speak on it

01:43:14.160 --> 01:43:17.160
we heard her concerns the committee discussed it as well

01:43:17.160 --> 01:43:21.160
when we were talking about the software that we're using

01:43:21.160 --> 01:43:22.160
and the cost of the software

01:43:22.160 --> 01:43:24.160
and what the software is supposed to do

01:43:24.160 --> 01:43:26.160
that's what the item before us is

01:43:26.160 --> 01:43:28.160
all related to the software

01:43:28.160 --> 01:43:30.160
the actual operation of it

01:43:30.160 --> 01:43:34.160
was a separate item that was already taken up previously

01:43:34.160 --> 01:43:38.160
so to hold up this software for something that

01:43:38.160 --> 01:43:42.160
I guess somebody missed when it was discussed last year

01:43:42.160 --> 01:43:44.160
for the actual operation of it

01:43:44.160 --> 01:43:46.160
I would throw a caution to it

01:43:46.160 --> 01:43:50.160
mainly because one of the big implications of this

01:43:50.160 --> 01:43:54.160
and why this is such an important piece of software

01:43:54.160 --> 01:43:56.160
is this isn't just parking meters

01:43:56.160 --> 01:43:59.160
this is also how tickets are written for parking

01:43:59.160 --> 01:44:01.160
there's been discussions around

01:44:01.160 --> 01:44:03.160
one of the things we've talked about

01:44:03.160 --> 01:44:05.160
actually in committee on it is

01:44:05.160 --> 01:44:07.160
this software allows the future

01:44:07.160 --> 01:44:09.160
for a potential ordinance change

01:44:09.160 --> 01:44:11.160
that supports progressive parking tickets

01:44:11.160 --> 01:44:13.160
if you have one

01:44:13.160 --> 01:44:15.160
it's one price if you write up six in a week

01:44:15.160 --> 01:44:17.160
it's a separate price

01:44:17.160 --> 01:44:19.160
once you get to the higher amounts

01:44:19.160 --> 01:44:21.160
so the piece of software if we want to send it back to discuss it

01:44:21.160 --> 01:44:23.160
absolutely but if we're sending it back

01:44:23.160 --> 01:44:27.160
to talk about a different topic that was done last year

01:44:27.160 --> 01:44:29.160
it's a totally different item

01:44:29.160 --> 01:44:31.160
I'm just failing to see how that makes sense

01:44:31.160 --> 01:44:33.160
so if we want to send it back

01:44:33.160 --> 01:44:35.160
have a discussion with residents

01:44:35.160 --> 01:44:37.160
around the software component all for it

01:44:37.160 --> 01:44:39.160
but if it sounds like there's maybe

01:44:39.160 --> 01:44:41.160
another alder that wants to submit a new communication

01:44:41.160 --> 01:44:43.160
to talk about what was done in 2025

01:44:43.160 --> 01:44:45.160
that would be a separate item

01:44:47.160 --> 01:44:49.160
Alder Davis

01:44:49.160 --> 01:44:53.160
My comments

01:44:53.160 --> 01:44:55.160
is the debate so

01:44:55.160 --> 01:44:57.160
I pass

01:44:57.160 --> 01:44:59.160
Alder Mack

01:45:03.160 --> 01:45:05.160
Thank you

01:45:05.160 --> 01:45:07.160
I originally came here

01:45:07.160 --> 01:45:09.160
prepared to make

01:45:09.160 --> 01:45:11.160
the same motion after receiving

01:45:11.160 --> 01:45:13.160
numerous calls from residents

01:45:13.160 --> 01:45:15.160
in my district

01:45:15.160 --> 01:45:17.160
I don't get a lot of calls

01:45:17.160 --> 01:45:21.160
but this one seemed to have triggered

01:45:21.160 --> 01:45:23.160
some interest

01:45:23.160 --> 01:45:25.160
and then also

01:45:25.160 --> 01:45:29.160
a business owner that has

01:45:29.160 --> 01:45:31.160
businesses in both the downtown area

01:45:31.160 --> 01:45:33.160
and my district although my district

01:45:33.160 --> 01:45:35.160
isn't affected by metered parking

01:45:35.160 --> 01:45:39.160
we do

01:45:39.160 --> 01:45:41.160
approve things that

01:45:41.160 --> 01:45:43.160
impact other districts as

01:45:43.160 --> 01:45:45.160
Aldermen

01:45:45.160 --> 01:45:47.160
I also

01:45:47.160 --> 01:45:49.160
thought the idea of

01:45:49.160 --> 01:45:51.160
jointly referring it

01:45:51.160 --> 01:45:53.160
to another

01:45:53.160 --> 01:45:55.160
committee might be appropriate

01:45:55.160 --> 01:45:57.160
because while there's

01:45:57.160 --> 01:45:59.160
the financial piece

01:45:59.160 --> 01:46:01.160
to this and that's what

01:46:01.160 --> 01:46:03.160
I voted on based on

01:46:03.160 --> 01:46:05.160
the information given

01:46:05.160 --> 01:46:07.160
last week

01:46:07.160 --> 01:46:09.160
however

01:46:09.160 --> 01:46:11.160
what people are saying

01:46:11.160 --> 01:46:13.160
is maybe this is

01:46:13.160 --> 01:46:15.160
the time

01:46:15.160 --> 01:46:17.160
with the parking meters

01:46:17.160 --> 01:46:19.160
becoming obsolete because

01:46:19.160 --> 01:46:21.160
they can't be fixed

01:46:21.160 --> 01:46:23.160
that we have a broader discussion on

01:46:23.160 --> 01:46:25.160
whether or not this is

01:46:25.160 --> 01:46:27.160
the time to get rid of

01:46:27.160 --> 01:46:29.160
metered parking

01:46:29.160 --> 01:46:31.160
so sending it

01:46:31.160 --> 01:46:33.160
back to the finance committee

01:46:33.160 --> 01:46:35.160
for more detail on the software

01:46:35.160 --> 01:46:37.160
if we got rid of

01:46:37.160 --> 01:46:39.160
metered parking as a software

01:46:39.160 --> 01:46:41.160
still needed

01:46:41.160 --> 01:46:43.160
or is it a different

01:46:43.160 --> 01:46:45.160
program I think would be

01:46:45.160 --> 01:46:47.160
appropriate but I still think

01:46:47.160 --> 01:46:49.160
maybe now is the time

01:46:49.160 --> 01:46:51.160
before we invest in

01:46:51.160 --> 01:46:53.160
kiosks and all that other stuff

01:46:53.160 --> 01:46:55.160
whether or not

01:46:55.160 --> 01:46:57.160
this is the time to get rid

01:46:57.160 --> 01:46:59.160
of metered parking and

01:46:59.160 --> 01:47:01.160
other municipalities

01:47:01.160 --> 01:47:03.160
have done it

01:47:03.160 --> 01:47:05.160
others maintain

01:47:05.160 --> 01:47:07.160
it and what is the right fit

01:47:07.160 --> 01:47:09.160
for Racine

01:47:09.160 --> 01:47:11.160
and what this kind of came

01:47:11.160 --> 01:47:13.160
about

01:47:13.160 --> 01:47:15.160
I'm sure there's a number of

01:47:15.160 --> 01:47:17.160
business owners

01:47:17.160 --> 01:47:19.160
that feel they have a stake in it

01:47:19.160 --> 01:47:21.160
there's residents that feel they

01:47:21.160 --> 01:47:23.160
have a stake in it

01:47:23.160 --> 01:47:25.160
and now I'm torn whether or not

01:47:25.160 --> 01:47:27.160
to vote no on the

01:47:27.160 --> 01:47:29.160
motion to refer it back

01:47:29.160 --> 01:47:31.160
to finance committee

01:47:31.160 --> 01:47:33.160
so that it

01:47:33.160 --> 01:47:35.160
can be jointly referred to

01:47:35.160 --> 01:47:37.160
public work so that

01:47:37.160 --> 01:47:39.160
it can be done

01:47:39.160 --> 01:47:41.160
so thank you

01:47:41.160 --> 01:47:43.160
thank you

01:47:43.160 --> 01:47:45.160
Mr. Mayor

01:47:45.160 --> 01:47:47.160
I'm going to speak in favor of just

01:47:47.160 --> 01:47:49.160
referring it back to finance because I

01:47:49.160 --> 01:47:51.160
distinctly remember having a

01:47:51.160 --> 01:47:53.160
conversation very similar to this

01:47:53.160 --> 01:47:55.160
and even having it brought up on

01:47:55.160 --> 01:47:57.160
I wasn't on public works and services

01:47:57.160 --> 01:47:59.160
when this originally came but

01:47:59.160 --> 01:48:01.160
I'm on it now and I know we had a

01:48:01.160 --> 01:48:03.160
conversation with Commissioner Rooney

01:48:03.160 --> 01:48:05.160
about this and he did say eventually we

01:48:05.160 --> 01:48:07.160
had a lot for people that don't

01:48:07.160 --> 01:48:09.160
can't get the app because that was a

01:48:09.160 --> 01:48:11.160
concern several of my colleagues

01:48:11.160 --> 01:48:13.160
that are here now brought up then

01:48:13.160 --> 01:48:15.160
was that that would be a concern

01:48:15.160 --> 01:48:17.160
however I do think if

01:48:17.160 --> 01:48:19.160
other others still feel there's more

01:48:19.160 --> 01:48:21.160
to the conversation that we can put

01:48:21.160 --> 01:48:23.160
a referral into the next public works

01:48:23.160 --> 01:48:25.160
and services committee to talk

01:48:25.160 --> 01:48:27.160
about this specific thing with the

01:48:27.160 --> 01:48:29.160
Commissioner even though this has

01:48:29.160 --> 01:48:31.160
already been sort of hashed out so

01:48:31.160 --> 01:48:33.160
I'm not in favor of a dual referral

01:48:33.160 --> 01:48:35.160
but I'm not in favor of any

01:48:35.160 --> 01:48:37.160
personnel as it pertains to the

01:48:37.160 --> 01:48:39.160
software thank you

01:48:39.160 --> 01:48:41.160
thank you

01:48:41.160 --> 01:48:43.160
just a quick question either for

01:48:43.160 --> 01:48:45.160
the finance director or the police

01:48:45.160 --> 01:48:47.160
chief regarding if there's a timeline

01:48:47.160 --> 01:48:49.160
required for this contract

01:48:49.160 --> 01:48:51.160
please take your question and

01:48:51.160 --> 01:48:53.160
while she's in transit hopefully she

01:48:53.160 --> 01:48:55.160
can so my question is

01:48:55.160 --> 01:48:57.160
is it going to interrupt

01:48:57.160 --> 01:48:59.160
the contract timeliness if we

01:48:59.160 --> 01:49:01.160
refer back to committee

01:49:01.160 --> 01:49:03.160
so no not necessarily

01:49:03.160 --> 01:49:05.160
it was

01:49:05.160 --> 01:49:07.160
envisioned within 2026

01:49:07.160 --> 01:49:09.160
for this already to be in operation

01:49:09.160 --> 01:49:11.160
it's why it was approved by

01:49:11.160 --> 01:49:13.160
public works and services in

01:49:13.160 --> 01:49:15.160
2025

01:49:15.160 --> 01:49:17.160
it took us a little while to make

01:49:17.160 --> 01:49:19.160
sure that the police department was

01:49:19.160 --> 01:49:21.160
properly equipped with the equipment

01:49:21.160 --> 01:49:23.160
that they needed to implement

01:49:23.160 --> 01:49:25.160
passport which is why we're so

01:49:25.160 --> 01:49:27.160
late in the year so we're already

01:49:27.160 --> 01:49:29.160
about six months behind

01:49:29.160 --> 01:49:31.160
however I understand the concerns

01:49:31.160 --> 01:49:33.160
obviously that have been addressed

01:49:33.160 --> 01:49:35.160
I do want to mention just one thing

01:49:35.160 --> 01:49:37.160
if a discussion is

01:49:37.160 --> 01:49:39.160
going to be had about eliminating

01:49:39.160 --> 01:49:41.160
parking meters

01:49:41.160 --> 01:49:43.160
that is a very very heavily

01:49:43.160 --> 01:49:45.160
fiscal decision

01:49:45.160 --> 01:49:47.160
so I want to be really

01:49:47.160 --> 01:49:49.160
careful if we're talking about

01:49:49.160 --> 01:49:51.160
taking this back to public works and

01:49:51.160 --> 01:49:53.160
services that item

01:49:53.160 --> 01:49:55.160
and that type of implementation

01:49:55.160 --> 01:49:57.160
or taking away parking

01:49:57.160 --> 01:49:59.160
meters would be about a

01:49:59.160 --> 01:50:01.160
$450,000

01:50:01.160 --> 01:50:03.160
item okay we

01:50:03.160 --> 01:50:05.160
receive about $450,000

01:50:05.160 --> 01:50:07.160
a year in revenue from parking

01:50:07.160 --> 01:50:09.160
meters alone

01:50:09.160 --> 01:50:11.160
that would just go

01:50:11.160 --> 01:50:13.160
boom that pays for parking

01:50:13.160 --> 01:50:15.160
structures it pays for parking

01:50:15.160 --> 01:50:17.160
lots being repaved it pays for

01:50:17.160 --> 01:50:19.160
public infrastructure

01:50:19.160 --> 01:50:21.160
that we have no other funding

01:50:21.160 --> 01:50:23.160
source to pay for so

01:50:23.160 --> 01:50:25.160
again it is

01:50:25.160 --> 01:50:27.160
it's definitely two departments or

01:50:27.160 --> 01:50:29.160
three at this particular

01:50:29.160 --> 01:50:31.160
instance I just want us to be

01:50:31.160 --> 01:50:33.160
really really careful about having

01:50:33.160 --> 01:50:35.160
that level of discussion about a

01:50:35.160 --> 01:50:37.160
very very heavily fiscal item

01:50:37.160 --> 01:50:39.160
only at public works and services

01:50:41.160 --> 01:50:43.160
can I just clarify

01:50:43.160 --> 01:50:45.160
with the finance director

01:50:45.160 --> 01:50:47.160
I don't proceed

01:50:47.160 --> 01:50:49.160
that the discussion was to remove

01:50:49.160 --> 01:50:51.160
parking meters

01:50:51.160 --> 01:50:53.160
well he brought

01:50:53.160 --> 01:50:55.160
and all the brought it up

01:50:55.160 --> 01:50:57.160
I understand that

01:50:57.160 --> 01:50:59.160
there are a lot of people

01:50:59.160 --> 01:51:01.160
out there right now saying those

01:51:01.160 --> 01:51:03.160
types of things and you know

01:51:03.160 --> 01:51:05.160
referring to other communities

01:51:05.160 --> 01:51:07.160
because of it it just those types

01:51:07.160 --> 01:51:09.160
of conversations again have an

01:51:09.160 --> 01:51:11.160
extreme fiscal impact that

01:51:11.160 --> 01:51:13.160
I would prefer to discuss a

01:51:13.160 --> 01:51:15.160
finance and personnel because it is

01:51:15.160 --> 01:51:17.160
a huge fiscal impact

01:51:17.160 --> 01:51:19.160
I just want to bring this back to

01:51:19.160 --> 01:51:21.160
the discussions that

01:51:21.160 --> 01:51:23.160
Elder Mack on the drop link

01:51:23.160 --> 01:51:25.160
does this software upgrade

01:51:25.160 --> 01:51:27.160
suddenly lead to an existential

01:51:27.160 --> 01:51:29.160
revisiting of all things

01:51:29.160 --> 01:51:31.160
related to parking and parking

01:51:31.160 --> 01:51:33.160
related fees apparently in this

01:51:33.160 --> 01:51:35.160
window it has however as several

01:51:35.160 --> 01:51:37.160
people have said if someone wants

01:51:37.160 --> 01:51:39.160
to put in a communication

01:51:39.160 --> 01:51:41.160
to revisit the entire

01:51:41.160 --> 01:51:43.160
regime that we use on parking and

01:51:43.160 --> 01:51:45.160
parking fees that would be a

01:51:45.160 --> 01:51:47.160
separate matter to be

01:51:47.160 --> 01:51:49.160
a software upgrade

01:51:49.160 --> 01:51:51.160
back to finance and personnel

01:51:51.160 --> 01:51:53.160
to clarify some related issues

01:51:53.160 --> 01:51:55.160
so Elder Hodges do you have the

01:51:55.160 --> 01:51:57.160
floor?

01:51:57.160 --> 01:51:59.160
Yeah I think I just need

01:51:59.160 --> 01:52:01.160
clarification as far as

01:52:01.160 --> 01:52:03.160
which department should be involved

01:52:03.160 --> 01:52:05.160
my main question is

01:52:05.160 --> 01:52:07.160
I think more of the

01:52:07.160 --> 01:52:09.160
operational standpoint

01:52:09.160 --> 01:52:11.160
what is the rollout strategy

01:52:11.160 --> 01:52:13.160
I want to understand the

01:52:13.160 --> 01:52:15.160
educational components for elders

01:52:15.160 --> 01:52:17.160
who may not know how to use

01:52:17.160 --> 01:52:19.160
this technology

01:52:19.160 --> 01:52:23.160
and also

01:52:23.160 --> 01:52:27.160
I believe in the proposal

01:52:27.160 --> 01:52:29.160
we are considering removing

01:52:29.160 --> 01:52:31.160
coin meters in its entirety

01:52:31.160 --> 01:52:33.160
is that correct?

01:52:33.160 --> 01:52:35.160
Yeah

01:52:43.160 --> 01:52:45.160
Elder Max points

01:52:45.160 --> 01:52:47.160
well taken so

01:52:47.160 --> 01:52:49.160
Elder Hodges this would be a great

01:52:49.160 --> 01:52:51.160
question if the motion to

01:52:51.160 --> 01:52:53.160
refer back failed and we were

01:52:53.160 --> 01:52:55.160
having the general debate on the

01:52:55.160 --> 01:52:57.160
floor of the council here today

01:52:57.160 --> 01:52:59.160
or if the motion to refer would be

01:52:59.160 --> 01:53:01.160
successful the time to bring it

01:53:01.160 --> 01:53:03.160
back to the full council but what is

01:53:03.160 --> 01:53:05.160
before us right now is a motion

01:53:05.160 --> 01:53:07.160
to refer the item back to the

01:53:07.160 --> 01:53:09.160
committee not to short circuit the

01:53:09.160 --> 01:53:11.160
debate on it but the motion is

01:53:11.160 --> 01:53:13.160
to refer the item to a committee

01:53:13.160 --> 01:53:15.160
to answer and clarify those questions

01:53:15.160 --> 01:53:17.160
in a more deliberate way than I

01:53:17.160 --> 01:53:19.160
think it was more people at least

01:53:19.160 --> 01:53:21.160
one potentially two additional

01:53:21.160 --> 01:53:23.160
venues to answer those questions.

01:53:23.160 --> 01:53:25.160
I don't mean to cut off your questions

01:53:25.160 --> 01:53:27.160
they are good questions but

01:53:27.160 --> 01:53:29.160
Elder Max point of order is well

01:53:29.160 --> 01:53:31.160
a discussion on the motion before

01:53:31.160 --> 01:53:33.160
us with just as a reminder is to

01:53:33.160 --> 01:53:35.160
refer this item back to

01:53:35.160 --> 01:53:37.160
finance and personnel.

01:53:37.160 --> 01:53:39.160
Seeing none when the clerk calls

01:53:39.160 --> 01:53:41.160
your name the motion before us is

01:53:41.160 --> 01:53:43.160
to refer this item back to

01:53:43.160 --> 01:53:45.160
finance and personnel when the

01:53:45.160 --> 01:53:47.160
clerk calls your name please vote

01:53:47.160 --> 01:53:49.160
as you wish.

01:53:49.160 --> 01:53:51.160
Elder Kelly

01:53:51.160 --> 01:53:53.160
Aye

01:53:53.160 --> 01:53:55.160
Elder Harmon

01:53:55.160 --> 01:53:57.160
Elder Bhavon

01:53:57.160 --> 01:53:59.160
Elder Mack

01:53:59.160 --> 01:54:01.160
Elder Jorgensen

01:54:01.160 --> 01:54:03.160
Elder Weiner

01:54:03.160 --> 01:54:05.160
Elder Horden

01:54:05.160 --> 01:54:07.160
Elder Hodges

01:54:07.160 --> 01:54:09.160
Elder Allen

01:54:09.160 --> 01:54:11.160
Elder Peay

01:54:11.160 --> 01:54:13.160
Elder Lan

01:54:13.160 --> 01:54:14.160
The motion referred to

01:54:14.160 --> 01:54:16.160
finance and personnel has passed

01:54:16.160 --> 01:54:17.160
unanimously.

01:54:17.160 --> 01:54:19.160
Elder Lan did you have any other

01:54:19.160 --> 01:54:21.160
requests for separate consideration

01:54:21.160 --> 01:54:23.160
on the items on your committee

01:54:23.160 --> 01:54:25.160
report?

01:54:25.160 --> 01:54:27.160
We will be placed on the consent agenda

01:54:27.160 --> 01:54:29.160
and we will move on to

01:54:29.160 --> 01:54:31.160
Elder Harmon for the public works

01:54:31.160 --> 01:54:33.160
and services committee report.

01:54:33.160 --> 01:54:35.160
Did you have any items for separate

01:54:35.160 --> 01:54:37.160
consideration?

01:54:37.160 --> 01:54:39.160
Then without objection the public

01:54:39.160 --> 01:54:41.160
works and services committee report

01:54:41.160 --> 01:54:43.160
will be placed on the consent agenda

01:54:43.160 --> 01:54:45.160
and then we will move on to public

01:54:45.160 --> 01:54:47.160
safety and licensing where I

01:54:47.160 --> 01:54:49.160
believe all the fees have one item

01:54:49.160 --> 01:54:51.160
for separate consideration.

01:54:51.160 --> 01:54:53.160
Elder Peay would you please read

01:54:53.160 --> 01:54:54.160
that item?

01:54:54.160 --> 01:54:56.160
The appearance of Natasha Evans

01:54:56.160 --> 01:54:58.160
agent for select 627

01:54:58.160 --> 01:55:00.160
located at 1111

01:55:00.160 --> 01:55:02.160
Watson Avenue

01:55:02.160 --> 01:55:04.160
pursuant to a formal expression

01:55:04.160 --> 01:55:06.160
concerning also a request and

01:55:06.160 --> 01:55:08.160
consideration of rescinding the

01:55:08.160 --> 01:55:10.160
formal expression of concern

01:55:10.160 --> 01:55:12.160
based on the committee report

01:55:12.160 --> 01:55:14.160
moved to approve.

01:55:14.160 --> 01:55:16.160
There's a motion

01:55:16.160 --> 01:55:18.160
and a second to approve this item

01:55:18.160 --> 01:55:20.160
I'll repeat.

01:55:20.160 --> 01:55:22.160
Did you want to speak further?

01:55:22.160 --> 01:55:24.160
I will not be supporting

01:55:24.160 --> 01:55:26.160
this motion

01:55:26.160 --> 01:55:28.160
and I would like to turn it over

01:55:28.160 --> 01:55:30.160
to all the Kelly first.

01:55:30.160 --> 01:55:32.160
I'm sorry, Elder Kelly.

01:55:32.160 --> 01:55:34.160
I did not see a virtual hand

01:55:34.160 --> 01:55:36.160
raised there.

01:55:36.160 --> 01:55:38.160
Elder Kelly, you have the floor.

01:55:38.160 --> 01:55:40.160
Thank you.

01:55:40.160 --> 01:55:42.160
As the maker of the

01:55:42.160 --> 01:55:44.160
motion at the committee

01:55:44.160 --> 01:55:46.160
I also, you know,

01:55:46.160 --> 01:55:48.160
I've had a lot of people

01:55:48.160 --> 01:55:50.160
reach out to me

01:55:50.160 --> 01:55:52.160
constituents business owners

01:55:52.160 --> 01:55:54.160
since our public safety

01:55:54.160 --> 01:55:56.160
and licensing meeting

01:55:56.160 --> 01:55:58.160
last week

01:55:58.160 --> 01:56:00.160
and in good faith I cannot

01:56:00.160 --> 01:56:02.160
support the decision that

01:56:02.160 --> 01:56:04.160
I made or we made at

01:56:04.160 --> 01:56:06.160
the committee level.

01:56:06.160 --> 01:56:08.160
And, you know,

01:56:08.160 --> 01:56:10.160
I think the right thing

01:56:10.160 --> 01:56:12.160
is to

01:56:12.160 --> 01:56:14.160
receive an

01:56:14.160 --> 01:56:18.160
file or however

01:56:18.160 --> 01:56:20.160
the city attorney

01:56:20.160 --> 01:56:22.160
is advising us

01:56:22.160 --> 01:56:24.160
but I'm not going to

01:56:24.160 --> 01:56:26.160
support the committee's

01:56:26.160 --> 01:56:28.160
decision at this point.

01:56:28.160 --> 01:56:30.160
So, I'm just going to ask the

01:56:30.160 --> 01:56:32.160
city attorney to comment on

01:56:32.160 --> 01:56:34.160
where we are proceeding to be here

01:56:34.160 --> 01:56:36.160
because we do have a motion

01:56:36.160 --> 01:56:38.160
that was made to approve the

01:56:38.160 --> 01:56:40.160
item with the maker of the motion

01:56:40.160 --> 01:56:42.160
is now saying that he's against it

01:56:42.160 --> 01:56:44.160
and Elder Kelly is asking

01:56:44.160 --> 01:56:46.160
what the appropriate motion might

01:56:46.160 --> 01:56:48.160
be.

01:56:48.160 --> 01:56:50.160
So, I asked the city attorney to

01:56:50.160 --> 01:56:52.160
comment on procedurally what's

01:56:52.160 --> 01:56:54.160
the appropriate stance here?

01:56:54.160 --> 01:56:56.160
Well, I mean, right now the

01:56:56.160 --> 01:56:58.160
motion is to approve unless

01:56:58.160 --> 01:57:00.160
Elder Kelly wants to make an

01:57:00.160 --> 01:57:02.160
amended motion to receive a

01:57:02.160 --> 01:57:04.160
file.

01:57:04.160 --> 01:57:06.160
I will say the discussion with a

01:57:06.160 --> 01:57:08.160
few orders I've had about this

01:57:08.160 --> 01:57:10.160
wouldn't have had it received

01:57:10.160 --> 01:57:12.160
and filed, it would have had it

01:57:12.160 --> 01:57:14.160
referred to the city attorney's

01:57:14.160 --> 01:57:16.160
decision.

01:57:16.160 --> 01:57:18.160
It would be a motion that

01:57:18.160 --> 01:57:20.160
for their disciplinary

01:57:20.160 --> 01:57:22.160
proceedings as exists pursuant

01:57:22.160 --> 01:57:24.160
to Racina ordinance 627 B1

01:57:24.160 --> 01:57:26.160
but it's the council's decision

01:57:26.160 --> 01:57:28.160
to make.

01:57:28.160 --> 01:57:30.160
Elder Kelly, did you hear that?

01:57:30.160 --> 01:57:32.160
Yes.

01:57:32.160 --> 01:57:34.160
So, if I'm understanding you

01:57:34.160 --> 01:57:36.160
correctly, I could make a motion

01:57:36.160 --> 01:57:38.160
to have this move to the

01:57:38.160 --> 01:57:40.160
attorney's office.

01:57:40.160 --> 01:57:42.160
If you don't mind, Elder Kelly,

01:57:42.160 --> 01:57:44.160
I would say that the attorney

01:57:44.160 --> 01:57:46.160
repeat the potential motion

01:57:46.160 --> 01:57:48.160
that he stated before and if you

01:57:48.160 --> 01:57:50.160
want to be the maker of that

01:57:50.160 --> 01:57:52.160
motion, that would be appropriate

01:57:52.160 --> 01:57:54.160
at this time.

01:57:54.160 --> 01:57:56.160
Okay.

01:57:56.160 --> 01:57:58.160
So, the motion would be to

01:57:58.160 --> 01:58:00.160
refer the licensee to the city

01:58:00.160 --> 01:58:02.160
attorney's office for consideration

01:58:02.160 --> 01:58:04.160
of further disciplinary

01:58:04.160 --> 01:58:06.160
proceedings as contemplated by

01:58:06.160 --> 01:58:08.160
Racina ordinances.

01:58:08.160 --> 01:58:10.160
So moved.

01:58:10.160 --> 01:58:12.160
I would like to speak any further

01:58:12.160 --> 01:58:14.160
to this motion.

01:58:14.160 --> 01:58:16.160
You know, I went back a little

01:58:16.160 --> 01:58:18.160
bit in the archives and

01:58:18.160 --> 01:58:20.160
the original license came

01:58:20.160 --> 01:58:24.160
before us January of 2024.

01:58:24.160 --> 01:58:26.160
And a couple of the items that

01:58:26.160 --> 01:58:28.160
really stick out to me is

01:58:28.160 --> 01:58:30.160
in the license application.

01:58:30.160 --> 01:58:32.160
It stated that, you know,

01:58:32.160 --> 01:58:34.160
that this would

01:58:34.160 --> 01:58:36.160
be a betterment for the city

01:58:36.160 --> 01:58:38.160
of Racine residents.

01:58:38.160 --> 01:58:40.160
I have not yet seen that

01:58:40.160 --> 01:58:42.160
happen.

01:58:42.160 --> 01:58:44.160
You know, the

01:58:44.160 --> 01:58:48.160
lack of working with our

01:58:48.160 --> 01:58:50.160
police officers who are

01:58:50.160 --> 01:58:52.160
dispatched there quite often

01:58:52.160 --> 01:58:54.160
is very concerning to me.

01:58:54.160 --> 01:58:56.160
And this has been going on

01:58:56.160 --> 01:58:58.160
for quite some time now.

01:58:58.160 --> 01:59:00.160
Um, you know, the, you know,

01:59:00.160 --> 01:59:02.160
the, um,

01:59:02.160 --> 01:59:04.160
you know, like I said, the

01:59:04.160 --> 01:59:06.160
application was January of

01:59:06.160 --> 01:59:08.160
2024.

01:59:08.160 --> 01:59:10.160
So we've kind of been going

01:59:10.160 --> 01:59:12.160
around and around with this.

01:59:12.160 --> 01:59:14.160
So, um, I think this is the

01:59:14.160 --> 01:59:16.160
right direction that we need to be

01:59:16.160 --> 01:59:18.160
headed.

01:59:18.160 --> 01:59:20.160
Thank you.

01:59:20.160 --> 01:59:22.160
All the Davis.

01:59:22.160 --> 01:59:24.160
Thank you.

01:59:24.160 --> 01:59:26.160
Um, tonight I want to speak about

01:59:26.160 --> 01:59:28.160
something that's bigger than

01:59:28.160 --> 01:59:30.160
licensing.

01:59:30.160 --> 01:59:32.160
It's bigger than one

01:59:32.160 --> 01:59:34.160
establishment.

01:59:34.160 --> 01:59:36.160
Bigger than one incident.

01:59:36.160 --> 01:59:38.160
And I like to talk about

01:59:38.160 --> 01:59:40.160
community accountability.

01:59:40.160 --> 01:59:42.160
Every time an incident occurs

01:59:42.160 --> 01:59:44.160
at one of our local

01:59:44.160 --> 01:59:46.160
establishments, the conversation

01:59:46.160 --> 01:59:48.160
quickly becomes, what should

01:59:48.160 --> 01:59:50.160
the owner have done?

01:59:50.160 --> 01:59:52.160
Now, that's a fair question.

01:59:52.160 --> 01:59:54.160
But I believe it's an

01:59:54.160 --> 01:59:56.160
incomplete question.

01:59:56.160 --> 01:59:58.160
We should also be asking

01:59:58.160 --> 02:00:00.160
what responsibility belongs to

02:00:00.160 --> 02:00:02.160
the patrons?

02:00:02.160 --> 02:00:04.160
What responsibility belongs to

02:00:04.160 --> 02:00:06.160
law enforcement?

02:00:06.160 --> 02:00:08.160
What responsibility belongs to

02:00:08.160 --> 02:00:10.160
us as a community?

02:00:10.160 --> 02:00:12.160
Because accountability

02:00:12.160 --> 02:00:14.160
doesn't just begin in with a

02:00:14.160 --> 02:00:16.160
business owner.

02:00:16.160 --> 02:00:18.160
Business owners have

02:00:18.160 --> 02:00:20.160
responsibility.

02:00:20.160 --> 02:00:22.160
Law enforcement has

02:00:22.160 --> 02:00:24.160
responsibilities.

02:00:24.160 --> 02:00:26.160
City leaders have

02:00:26.160 --> 02:00:28.160
responsibilities to.

02:00:28.160 --> 02:00:32.160
If an individual chooses violence,

02:00:32.160 --> 02:00:34.160
if someone carries a weapon,

02:00:34.160 --> 02:00:38.160
if someone starts a fight,

02:00:38.160 --> 02:00:40.160
if someone refuses to walk away,

02:00:40.160 --> 02:00:44.160
those are personal decisions.

02:00:44.160 --> 02:00:46.160
Accountability should

02:00:46.160 --> 02:00:48.160
follow the person who made

02:00:48.160 --> 02:00:50.160
that choice.

02:00:50.160 --> 02:00:54.160
Too often we ask business owners

02:00:54.160 --> 02:00:56.160
to answer for decisions they

02:00:56.160 --> 02:00:58.160
did not make.

02:00:58.160 --> 02:01:00.160
That doesn't mean

02:01:00.160 --> 02:01:02.160
owners shouldn't be held accountable.

02:01:02.160 --> 02:01:04.160
When they fail to meet the

02:01:04.160 --> 02:01:06.160
obligations, they absolutely should.

02:01:06.160 --> 02:01:08.160
But it also means that we

02:01:08.160 --> 02:01:10.160
cannot ignore the role

02:01:10.160 --> 02:01:12.160
individual choices play in

02:01:12.160 --> 02:01:14.160
creating safe and unsafe

02:01:14.160 --> 02:01:16.160
environments.

02:01:16.160 --> 02:01:18.160
Every person, every person

02:01:18.160 --> 02:01:20.160
deserves to enjoy a night out

02:01:20.160 --> 02:01:22.160
and return home safely.

02:01:22.160 --> 02:01:24.160
Every person that includes

02:01:24.160 --> 02:01:26.160
the customer,

02:01:26.160 --> 02:01:28.160
the bartender,

02:01:28.160 --> 02:01:30.160
the DJ,

02:01:30.160 --> 02:01:32.160
the security guard,

02:01:32.160 --> 02:01:34.160
the server,

02:01:34.160 --> 02:01:36.160
the business owner,

02:01:36.160 --> 02:01:38.160
and the police officers

02:01:38.160 --> 02:01:40.160
responding to the call.

02:01:40.160 --> 02:01:42.160
A neighbor who simply want

02:01:42.160 --> 02:01:44.160
peace in their community.

02:01:44.160 --> 02:01:46.160
Every single person

02:01:46.160 --> 02:01:48.160
deserves to be held

02:01:48.160 --> 02:01:50.160
safely.

02:01:50.160 --> 02:01:52.160
These places are places

02:01:52.160 --> 02:01:54.160
where people celebrate their

02:01:54.160 --> 02:01:56.160
birthdays,

02:01:56.160 --> 02:01:58.160
where old friends we connect,

02:01:58.160 --> 02:02:00.160
where families gather,

02:02:00.160 --> 02:02:02.160
where music is shared,

02:02:02.160 --> 02:02:04.160
where entrepreneurs

02:02:04.160 --> 02:02:06.160
invest their dreams.

02:02:06.160 --> 02:02:08.160
Many of these owners

02:02:08.160 --> 02:02:10.160
have poured years of

02:02:10.160 --> 02:02:12.160
hard work,

02:02:12.160 --> 02:02:14.160
sacrifice, and hope

02:02:14.160 --> 02:02:16.160
is building something

02:02:16.160 --> 02:02:20.160
positive for our community.

02:02:20.160 --> 02:02:22.160
If we truly want to

02:02:22.160 --> 02:02:24.160
support local businesses,

02:02:24.160 --> 02:02:26.160
support must be more than

02:02:26.160 --> 02:02:28.160
showing up.

02:02:28.160 --> 02:02:30.160
Support means protecting

02:02:30.160 --> 02:02:32.160
them, protecting them

02:02:32.160 --> 02:02:34.160
with our choices,

02:02:34.160 --> 02:02:36.160
protecting them with our

02:02:36.160 --> 02:02:38.160
words, protecting them by

02:02:38.160 --> 02:02:40.160
walking away instead of

02:02:40.160 --> 02:02:42.160
escalating, protecting them by

02:02:42.160 --> 02:02:44.160
looking out for one another

02:02:44.160 --> 02:02:46.160
because one moment, one poor

02:02:46.160 --> 02:02:48.160
decision, one unnecessary

02:02:48.160 --> 02:02:50.160
act of violence

02:02:50.160 --> 02:02:52.160
can change someone's life

02:02:52.160 --> 02:02:54.160
forever.

02:02:54.160 --> 02:02:56.160
I believe we can do better.

02:02:56.160 --> 02:02:58.160
I believe we should expect more

02:02:58.160 --> 02:03:00.160
of ourselves, not because

02:03:00.160 --> 02:03:02.160
someone is watching, but

02:03:02.160 --> 02:03:04.160
because we choose to be

02:03:04.160 --> 02:03:06.160
less become known as a community

02:03:06.160 --> 02:03:08.160
that values respect over

02:03:08.160 --> 02:03:10.160
retaliation, peace over

02:03:10.160 --> 02:03:12.160
pride, responsibilities

02:03:12.160 --> 02:03:14.160
over excuses.

02:03:14.160 --> 02:03:16.160
Let's create spaces where

02:03:16.160 --> 02:03:18.160
people feel welcome, where

02:03:18.160 --> 02:03:20.160
businesses can thrive, and

02:03:20.160 --> 02:03:22.160
where families know they can

02:03:22.160 --> 02:03:24.160
gather safely, because at the end

02:03:24.160 --> 02:03:26.160
of the day, everyone deserves

02:03:26.160 --> 02:03:28.160
to enjoy themselves, and

02:03:28.160 --> 02:03:30.160
everyone deserves to return

02:03:30.160 --> 02:03:32.160
home safely.

02:03:32.160 --> 02:03:34.160
So tonight, I just leave

02:03:34.160 --> 02:03:36.160
you with this challenge.

02:03:36.160 --> 02:03:38.160
Protect the people, protect the

02:03:38.160 --> 02:03:40.160
place, and help everyone get

02:03:40.160 --> 02:03:42.160
home safely, because the thing

02:03:42.160 --> 02:03:44.160
is, as I brought up in

02:03:44.160 --> 02:03:48.160
committee, we have to look into

02:03:48.160 --> 02:03:50.160
accountability for all the

02:03:50.160 --> 02:03:52.160
characters, especially the

02:03:52.160 --> 02:03:54.160
patrons who are coming

02:03:54.160 --> 02:03:56.160
and interrupting folks'

02:03:56.160 --> 02:03:58.160
business in their livelihoods.

02:03:58.160 --> 02:04:00.160
So if you watch the committee

02:04:00.160 --> 02:04:02.160
meeting, I brought up the

02:04:02.160 --> 02:04:04.160
concern of ordering.

02:04:04.160 --> 02:04:06.160
What does ordering look like?

02:04:06.160 --> 02:04:08.160
How do we move forward with law

02:04:08.160 --> 02:04:10.160
and how do we take it in?

02:04:10.160 --> 02:04:16.160
So I'm speaking against

02:04:16.160 --> 02:04:18.160
the motion that was put forward

02:04:18.160 --> 02:04:20.160
by Arthur Kelly to move forward

02:04:20.160 --> 02:04:22.160
with City Attorney, because

02:04:22.160 --> 02:04:24.160
the conversation is deeper than

02:04:24.160 --> 02:04:26.160
just one spot.

02:04:26.160 --> 02:04:28.160
It's about this community, and we

02:04:28.160 --> 02:04:30.160
need to dive deep in the

02:04:30.160 --> 02:04:32.160
Lordering ordinance, our

02:04:32.160 --> 02:04:34.160
disorderly conduct ordinance, and

02:04:34.160 --> 02:04:36.160
actually stick it to the people

02:04:36.160 --> 02:04:38.160
that are coming in, and

02:04:38.160 --> 02:04:40.160
interrupting folks'

02:04:40.160 --> 02:04:42.160
businesses.

02:04:42.160 --> 02:04:44.160
I'm completely.

02:04:44.160 --> 02:04:46.160
Thank you, Mr. Mayor.

02:04:46.160 --> 02:04:48.160
I'm going to speak in favor of

02:04:48.160 --> 02:04:50.160
sending this to the City

02:04:50.160 --> 02:04:51.160
Attorney's office.

02:04:51.160 --> 02:04:53.160
I recognize this particular

02:04:53.160 --> 02:04:55.160
business from my time on public

02:04:55.160 --> 02:04:57.160
safety and licensing, and I'm

02:04:57.160 --> 02:04:58.160
the sergeant there that provides

02:04:58.160 --> 02:05:00.160
the licensed premise report does

02:05:00.160 --> 02:05:02.160
a fantastic job of explaining

02:05:02.160 --> 02:05:04.160
what is going on, just because

02:05:04.160 --> 02:05:06.160
sometimes it's the bartender's

02:05:06.160 --> 02:05:08.160
calling for a disruptive patron,

02:05:08.160 --> 02:05:10.160
what have you, and that's what

02:05:10.160 --> 02:05:12.160
the committee considers.

02:05:12.160 --> 02:05:14.160
I do think that we're talking

02:05:14.160 --> 02:05:16.160
about accountability, and I think

02:05:16.160 --> 02:05:18.160
the police department does a great

02:05:18.160 --> 02:05:20.160
job of responding to these.

02:05:20.160 --> 02:05:22.160
Are there ordinances and whatnot

02:05:22.160 --> 02:05:24.160
that could be enforced better

02:05:24.160 --> 02:05:26.160
absolutely, but that is a

02:05:26.160 --> 02:05:28.160
conversation that's being preferred,

02:05:28.160 --> 02:05:30.160
actually, to have that conversation.

02:05:30.160 --> 02:05:32.160
And I think accountability

02:05:32.160 --> 02:05:34.160
is that yes, this particular

02:05:34.160 --> 02:05:36.160
establishment is at this point

02:05:36.160 --> 02:05:38.160
where I believe this is just

02:05:38.160 --> 02:05:40.160
justified, but there are some

02:05:40.160 --> 02:05:42.160
other establishments that are to

02:05:42.160 --> 02:05:44.160
that point as well.

02:05:44.160 --> 02:05:46.160
So we need to apply that equally

02:05:46.160 --> 02:05:47.160
in my opinion.

02:05:47.160 --> 02:05:49.160
I'm no longer on the committee, but

02:05:49.160 --> 02:05:51.160
I can express my opinion as an

02:05:51.160 --> 02:05:53.160
alder, and I am in support of this

02:05:53.160 --> 02:05:55.160
because this is an issue that needs

02:05:55.160 --> 02:05:57.160
to be addressed, but it's the same

02:05:57.160 --> 02:05:59.160
way as we ask citizens to take

02:05:59.160 --> 02:06:01.160
accountability for speeding,

02:06:01.160 --> 02:06:03.160
changing the behavior.

02:06:03.160 --> 02:06:05.160
It's understanding that you are

02:06:05.160 --> 02:06:07.160
part of this giant ecosystem

02:06:07.160 --> 02:06:09.160
that supports our local community,

02:06:09.160 --> 02:06:11.160
and you have to do your part.

02:06:11.160 --> 02:06:13.160
People don't, but that's what the

02:06:13.160 --> 02:06:15.160
police department is there for,

02:06:15.160 --> 02:06:17.160
to enforce the laws.

02:06:17.160 --> 02:06:19.160
And if they're not, then that's

02:06:19.160 --> 02:06:21.160
the separate conversation we need

02:06:21.160 --> 02:06:23.160
to be having, but if we've already

02:06:23.160 --> 02:06:25.160
given business owners the

02:06:25.160 --> 02:06:27.160
opportunities, the resources, and

02:06:27.160 --> 02:06:29.160
they've already had good neighbors

02:06:29.160 --> 02:06:31.160
and they've given them the

02:06:31.160 --> 02:06:33.160
particular few establishments that

02:06:33.160 --> 02:06:35.160
are always on that premise report

02:06:35.160 --> 02:06:37.160
because it is an issue.

02:06:37.160 --> 02:06:38.160
So it's not everyone.

02:06:38.160 --> 02:06:40.160
So there is something unique to

02:06:40.160 --> 02:06:42.160
those situations where we've

02:06:42.160 --> 02:06:43.160
given them the resources and the

02:06:43.160 --> 02:06:44.160
tools.

02:06:44.160 --> 02:06:45.160
It's up to them to utilize, and

02:06:45.160 --> 02:06:46.160
now we're at the point where I

02:06:46.160 --> 02:06:47.160
believe we have exhausted that.

02:06:47.160 --> 02:06:48.160
We've done our diligence and it's

02:06:48.160 --> 02:06:50.160
up for them to deal with the city

02:06:50.160 --> 02:06:52.160
attorney's office to come up with

02:06:52.160 --> 02:06:53.160
an understanding.

02:06:53.160 --> 02:06:55.160
So I will support it to send it

02:06:55.160 --> 02:06:56.160
to the city attorney's office.

02:06:56.160 --> 02:06:57.160
Thank you.

02:06:58.160 --> 02:07:00.160
I just wanted to say that I'm

02:07:00.160 --> 02:07:02.160
in support of Elder Kelly's

02:07:02.160 --> 02:07:04.160
motion to refer it.

02:07:04.160 --> 02:07:06.160
Obviously, I'm a newer member of

02:07:06.160 --> 02:07:08.160
the committee, so I didn't have

02:07:08.160 --> 02:07:10.160
some of the background that was

02:07:10.160 --> 02:07:13.160
later shared from previous years.

02:07:13.160 --> 02:07:15.160
Basically, for me, it came down

02:07:15.160 --> 02:07:17.160
to two establishments that were

02:07:17.160 --> 02:07:18.160
called in.

02:07:18.160 --> 02:07:20.160
One took ownership, one didn't.

02:07:20.160 --> 02:07:22.160
One talked about collaborating

02:07:22.160 --> 02:07:24.160
with the police, the cop house

02:07:24.160 --> 02:07:25.160
downtown.

02:07:26.160 --> 02:07:28.160
One talked about being on site

02:07:28.160 --> 02:07:30.160
during these times that they knew

02:07:30.160 --> 02:07:32.160
were troublesome being in the

02:07:32.160 --> 02:07:34.160
establishment to be a presence,

02:07:34.160 --> 02:07:36.160
putting things in place to try to

02:07:36.160 --> 02:07:38.160
curb some of the behavior.

02:07:38.160 --> 02:07:40.160
And I just really felt like the

02:07:40.160 --> 02:07:42.160
other just talked about not even

02:07:42.160 --> 02:07:44.160
being there, what our bartenders

02:07:44.160 --> 02:07:46.160
are telling her, and also just

02:07:46.160 --> 02:07:48.160
the blocking the law enforcement

02:07:48.160 --> 02:07:50.160
when they're coming in to try to

02:07:50.160 --> 02:07:52.160
respond to calls.

02:07:52.160 --> 02:07:54.160
I know that we've had some

02:07:54.160 --> 02:07:56.160
public speakers tonight, and we've

02:07:56.160 --> 02:07:57.160
had some discussion at committee

02:07:57.160 --> 02:07:58.160
about consistency.

02:07:58.160 --> 02:08:00.160
That is definitely something that

02:08:00.160 --> 02:08:01.160
I want to be a part of.

02:08:01.160 --> 02:08:03.160
I want to be a part of fairness.

02:08:03.160 --> 02:08:05.160
I want to be a part of consistency.

02:08:05.160 --> 02:08:07.160
And when I left the meeting, I

02:08:07.160 --> 02:08:09.160
felt like the consequence for

02:08:09.160 --> 02:08:10.160
these two establishments didn't

02:08:10.160 --> 02:08:11.160
feel fair.

02:08:11.160 --> 02:08:13.160
I felt like one was really

02:08:13.160 --> 02:08:14.160
collaborating and working.

02:08:14.160 --> 02:08:16.160
I also agree that the

02:08:16.160 --> 02:08:18.160
conversations about loitering and

02:08:18.160 --> 02:08:20.160
what we can do to support when

02:08:20.160 --> 02:08:21.160
they're implementing strategies

02:08:21.160 --> 02:08:23.160
and people are continuing to just

02:08:23.160 --> 02:08:24.160
stay in the area.

02:08:24.160 --> 02:08:26.160
I really appreciate those conversations

02:08:26.160 --> 02:08:28.160
too, how we can support those

02:08:28.160 --> 02:08:30.160
business owners, but I also feel

02:08:30.160 --> 02:08:32.160
that just the one establishment

02:08:32.160 --> 02:08:34.160
didn't seem to take the ownership

02:08:34.160 --> 02:08:36.160
or even just be in the vicinity

02:08:36.160 --> 02:08:38.160
when things are happening.

02:08:38.160 --> 02:08:40.160
And so I would support all

02:08:40.160 --> 02:08:41.160
of this motion.

02:08:41.160 --> 02:08:43.160
All of the Frazier.

02:08:43.160 --> 02:08:46.160
I have a question for the city

02:08:46.160 --> 02:08:47.160
attorney.

02:08:47.160 --> 02:08:49.160
Please take your question.

02:08:49.160 --> 02:08:52.160
So this gets referred to your

02:08:52.160 --> 02:08:53.160
office.

02:08:53.160 --> 02:08:56.160
Can you just explain what the next

02:08:56.160 --> 02:08:59.160
steps are so that we're all on the

02:08:59.160 --> 02:09:02.160
same page of what the next steps

02:09:02.160 --> 02:09:04.160
could possibly look like?

02:09:04.160 --> 02:09:05.160
Sure.

02:09:05.160 --> 02:09:09.160
Formally it's referred for potential

02:09:09.160 --> 02:09:11.160
disciplinary proceedings.

02:09:11.160 --> 02:09:15.160
Again, the formal process would be

02:09:15.160 --> 02:09:18.160
for a complaint initiated by my

02:09:18.160 --> 02:09:19.160
officer.

02:09:19.160 --> 02:09:21.160
It can be a sworn complaint from

02:09:21.160 --> 02:09:25.160
other people that gets found

02:09:25.160 --> 02:09:27.160
with the city clerk's office and

02:09:27.160 --> 02:09:29.160
it proceeds potentially to a due

02:09:29.160 --> 02:09:30.160
process hearing.

02:09:30.160 --> 02:09:32.160
A due process hearing, frankly,

02:09:32.160 --> 02:09:35.160
would be to consider whether or not

02:09:35.160 --> 02:09:38.160
to revoke the alcohol beverage

02:09:38.160 --> 02:09:39.160
license.

02:09:39.160 --> 02:09:41.160
And as you've heard me talk about

02:09:41.160 --> 02:09:43.160
all of you, alcohol beverage

02:09:43.160 --> 02:09:45.160
licenses once they are approved,

02:09:45.160 --> 02:09:47.160
once they're granted our property

02:09:47.160 --> 02:09:49.160
right there, constitutional

02:09:49.160 --> 02:09:51.160
rights piece of property that

02:09:51.160 --> 02:09:53.160
people have and it cannot be

02:09:53.160 --> 02:09:55.160
non-renewter revoked without

02:09:55.160 --> 02:09:56.160
process.

02:09:56.160 --> 02:09:58.160
That's why there is a due

02:09:58.160 --> 02:09:59.160
process board.

02:09:59.160 --> 02:10:01.160
So just because that process is

02:10:01.160 --> 02:10:03.160
initiated does not mean

02:10:03.160 --> 02:10:05.160
necessarily that a due process

02:10:05.160 --> 02:10:08.160
hearing will take place with the

02:10:08.160 --> 02:10:11.160
mind of having the license

02:10:11.160 --> 02:10:12.160
revoked.

02:10:12.160 --> 02:10:14.160
Quite frankly, more often there's

02:10:14.160 --> 02:10:15.160
probably some sort of

02:10:15.160 --> 02:10:18.160
negotiations that take place in an

02:10:18.160 --> 02:10:20.160
attempt to settle whatever the

02:10:20.160 --> 02:10:22.160
issues are and we certainly would

02:10:22.160 --> 02:10:24.160
involve the police department.

02:10:24.160 --> 02:10:26.160
If there's other, and I'm just

02:10:26.160 --> 02:10:28.160
making this up right now, if there's

02:10:28.160 --> 02:10:30.160
building coal violations or health

02:10:30.160 --> 02:10:32.160
department violations, those

02:10:32.160 --> 02:10:34.160
departments would be involved as

02:10:34.160 --> 02:10:35.160
well.

02:10:35.160 --> 02:10:37.160
Sometimes there's a suggestion of

02:10:37.160 --> 02:10:39.160
more security or more cameras or

02:10:39.160 --> 02:10:41.160
changing of hours or any number of

02:10:41.160 --> 02:10:42.160
things.

02:10:42.160 --> 02:10:44.160
Whatever we might come up with and

02:10:44.160 --> 02:10:46.160
it's attorney poplin that

02:10:46.160 --> 02:10:48.160
would go back then to the public

02:10:48.160 --> 02:10:50.160
safety and licensing committee.

02:10:50.160 --> 02:10:52.160
For consideration, if that committee

02:10:52.160 --> 02:10:54.160
didn't like whatever that was,

02:10:54.160 --> 02:10:56.160
the either tell us to go try again

02:10:56.160 --> 02:10:58.160
or I suppose potentially say we're

02:10:58.160 --> 02:11:00.160
not going to be happy with anything

02:11:00.160 --> 02:11:02.160
just move forward with the due

02:11:02.160 --> 02:11:03.160
process hearing.

02:11:03.160 --> 02:11:06.160
But again, that becomes a matter of

02:11:06.160 --> 02:11:08.160
prosecutorial discretion essentially

02:11:08.160 --> 02:11:10.160
in the city attorney's office to

02:11:10.160 --> 02:11:12.160
then move forward to that hearing.

02:11:12.160 --> 02:11:14.160
And there is a due process board,

02:11:14.160 --> 02:11:16.160
of course, you know, that the city has.

02:11:16.160 --> 02:11:18.160
And then my follow-up question,

02:11:18.160 --> 02:11:20.160
this is kind of putting the car

02:11:20.160 --> 02:11:22.160
before the horse, but I think it's

02:11:22.160 --> 02:11:24.160
important to ask is, if there is

02:11:24.160 --> 02:11:26.160
some type of agreement that's

02:11:26.160 --> 02:11:28.160
reached, are there checks and

02:11:28.160 --> 02:11:30.160
balances in place for that business?

02:11:30.160 --> 02:11:32.160
There are conditions, compliance

02:11:32.160 --> 02:11:34.160
conditions, generally speaking.

02:11:34.160 --> 02:11:36.160
There could be, you know, a lot of

02:11:36.160 --> 02:11:37.160
things.

02:11:37.160 --> 02:11:39.160
There are conditions, you know,

02:11:39.160 --> 02:11:41.160
compliance conditions, generally

02:11:41.160 --> 02:11:43.160
speaking, there could be, and again,

02:11:43.160 --> 02:11:44.160
I'm just making this up.

02:11:44.160 --> 02:11:46.160
I don't know if it exists in this case,

02:11:46.160 --> 02:11:48.160
but there could be requirements of

02:11:48.160 --> 02:11:50.160
inspections, certainly the

02:11:50.160 --> 02:11:52.160
requirements of cooperation with

02:11:52.160 --> 02:11:54.160
police and other city authorities.

02:11:54.160 --> 02:11:56.160
So there would be a requirement to

02:11:56.160 --> 02:11:58.160
comply with whatever the agreement

02:11:58.160 --> 02:12:00.160
is and failure to comply with the

02:12:00.160 --> 02:12:02.160
agreement, then could result in

02:12:02.160 --> 02:12:04.160
immediately being sent to a due

02:12:04.160 --> 02:12:06.160
system.

02:12:06.160 --> 02:12:08.160
I have a question for the chief.

02:12:08.160 --> 02:12:12.160
Sorry to make you walk.

02:12:12.160 --> 02:12:14.160
So while you walk, I know you can

02:12:14.160 --> 02:12:16.160
hear me.

02:12:16.160 --> 02:12:18.160
So I'd just like to get your

02:12:18.160 --> 02:12:22.160
feedback on this particular issue,

02:12:22.160 --> 02:12:24.160
just so, again, there is full

02:12:24.160 --> 02:12:26.160
disclosure and we're all on the

02:12:26.160 --> 02:12:28.160
same page and hearing the same

02:12:28.160 --> 02:12:30.160
information.

02:12:30.160 --> 02:12:32.160
When it comes to certain

02:12:32.160 --> 02:12:34.160
concerns, I'm not sure where

02:12:34.160 --> 02:12:36.160
the

02:12:36.160 --> 02:12:38.160
report is.

02:12:38.160 --> 02:12:40.160
Obviously, public safety is

02:12:40.160 --> 02:12:42.160
our number one concern.

02:12:42.160 --> 02:12:44.160
What we do is on the reports that

02:12:44.160 --> 02:12:46.160
we give to the public safety and

02:12:46.160 --> 02:12:48.160
license committee are factual

02:12:48.160 --> 02:12:50.160
incidents that happen.

02:12:50.160 --> 02:12:52.160
We leave it up to the community

02:12:52.160 --> 02:12:54.160
to vote to continue.

02:12:54.160 --> 02:12:56.160
Sometimes it does get referred to

02:12:56.160 --> 02:12:58.160
the city attorney's office.

02:12:58.160 --> 02:13:00.160
When we spend a lot of resources

02:13:00.160 --> 02:13:02.160
that we still got to protect the

02:13:02.160 --> 02:13:04.160
city with 15 square miles.

02:13:04.160 --> 02:13:06.160
It's a lot.

02:13:06.160 --> 02:13:08.160
This particular location demands our

02:13:08.160 --> 02:13:10.160
resources.

02:13:10.160 --> 02:13:12.160
We've had some extreme violence over

02:13:12.160 --> 02:13:14.160
there.

02:13:14.160 --> 02:13:16.160
When we had a young lady get killed

02:13:16.160 --> 02:13:18.160
just for doing a tick-tock.

02:13:18.160 --> 02:13:20.160
Maybe we had a shooting a couple

02:13:20.160 --> 02:13:22.160
weeks ago over the weekend, but

02:13:22.160 --> 02:13:24.160
two people got into it.

02:13:24.160 --> 02:13:26.160
They know each other and decided to

02:13:26.160 --> 02:13:28.160
bring out firearms.

02:13:28.160 --> 02:13:30.160
They know each other.

02:13:30.160 --> 02:13:32.160
They know each other.

02:13:32.160 --> 02:13:34.160
Everything that all of their

02:13:34.160 --> 02:13:36.160
Davis said, 100 percent accurate.

02:13:36.160 --> 02:13:38.160
There's a balance that we have to

02:13:38.160 --> 02:13:40.160
have.

02:13:40.160 --> 02:13:42.160
I'm struggling because it is

02:13:42.160 --> 02:13:44.160
my district.

02:13:44.160 --> 02:13:46.160
I want to be supportive

02:13:46.160 --> 02:13:48.160
and a voice for

02:13:48.160 --> 02:13:50.160
everyone in my district.

02:13:50.160 --> 02:13:52.160
However, the accountability piece

02:13:52.160 --> 02:13:54.160
as Audra Pobon

02:13:54.160 --> 02:13:58.160
hit on is major.

02:13:58.160 --> 02:14:00.160
With this, we don't know what's

02:14:00.160 --> 02:14:02.160
going to happen next.

02:14:02.160 --> 02:14:04.160
If this motion passes by other

02:14:04.160 --> 02:14:06.160
Kelly, I do think that this is

02:14:06.160 --> 02:14:08.160
an appropriate step.

02:14:08.160 --> 02:14:10.160
Considering, you know,

02:14:10.160 --> 02:14:12.160
it was initially agreed to go to

02:14:12.160 --> 02:14:14.160
a good neighbors meeting.

02:14:14.160 --> 02:14:16.160
I think this puts a little bit

02:14:16.160 --> 02:14:18.160
more onus on the business owner.

02:14:18.160 --> 02:14:20.160
A little bit more pressure to

02:14:20.160 --> 02:14:22.160
rectify some of the issues.

02:14:22.160 --> 02:14:26.160
I will support this motion

02:14:26.160 --> 02:14:30.160
in hopes that we can come to

02:14:30.160 --> 02:14:32.160
some sort of agreement.

02:14:32.160 --> 02:14:34.160
In addition to what other

02:14:34.160 --> 02:14:36.160
Davis eloquently put out,

02:14:36.160 --> 02:14:38.160
have a broader conversation

02:14:38.160 --> 02:14:40.160
about support for these businesses

02:14:40.160 --> 02:14:42.160
and holding these

02:14:42.160 --> 02:14:44.160
I'm not to call them,

02:14:44.160 --> 02:14:46.160
but the participants

02:14:46.160 --> 02:14:48.160
or the people who attend these

02:14:48.160 --> 02:14:50.160
businesses, holding them accountable.

02:14:50.160 --> 02:14:52.160
I think that that's a broader

02:14:52.160 --> 02:14:54.160
conversation.

02:14:54.160 --> 02:14:56.160
Thank you.

02:14:56.160 --> 02:14:58.160
We do have four more people in the

02:14:58.160 --> 02:15:00.160
queue.

02:15:00.160 --> 02:15:02.160
Again, if you were more than welcome

02:15:02.160 --> 02:15:04.160
to offer your comments on the item,

02:15:04.160 --> 02:15:06.160
but if you feel like the comments

02:15:06.160 --> 02:15:08.160
have already been made,

02:15:08.160 --> 02:15:10.160
we could also move the conversation

02:15:10.160 --> 02:15:12.160
along Audra Machia before.

02:15:12.160 --> 02:15:14.160
Thank you.

02:15:14.160 --> 02:15:16.160
On my prior

02:15:16.160 --> 02:15:18.160
tenure with the council,

02:15:18.160 --> 02:15:20.160
I was very interested in

02:15:20.160 --> 02:15:22.160
licensing.

02:15:22.160 --> 02:15:24.160
Chair of that committee

02:15:24.160 --> 02:15:26.160
for a couple of years

02:15:26.160 --> 02:15:28.160
and became very familiar with

02:15:28.160 --> 02:15:30.160
bars that were frequent

02:15:30.160 --> 02:15:32.160
flyers.

02:15:32.160 --> 02:15:34.160
And yet there are bars out there

02:15:34.160 --> 02:15:36.160
that you never hear from.

02:15:36.160 --> 02:15:38.160
And so

02:15:38.160 --> 02:15:40.160
one has to ask the question

02:15:40.160 --> 02:15:42.160
why is that?

02:15:42.160 --> 02:15:44.160
Alderman Davis raises some good

02:15:44.160 --> 02:15:46.160
questions.

02:15:46.160 --> 02:15:48.160
I'm going to ask back

02:15:48.160 --> 02:15:50.160
20 years ago

02:15:50.160 --> 02:15:52.160
with

02:15:52.160 --> 02:15:54.160
some of the issues that we were

02:15:54.160 --> 02:15:56.160
seeing because it is like a

02:15:56.160 --> 02:15:58.160
stool you have.

02:15:58.160 --> 02:16:00.160
The business owner is one leg.

02:16:00.160 --> 02:16:02.160
The patrons are another leg.

02:16:02.160 --> 02:16:04.160
The community or law enforcement

02:16:04.160 --> 02:16:06.160
said third leg.

02:16:06.160 --> 02:16:08.160
We'd see 100 people spill

02:16:08.160 --> 02:16:10.160
out onto six street

02:16:10.160 --> 02:16:12.160
and all the police department.

02:16:12.160 --> 02:16:14.160
The question was raised.

02:16:14.160 --> 02:16:16.160
Why aren't you citing

02:16:16.160 --> 02:16:18.160
the unruly patrons

02:16:18.160 --> 02:16:20.160
and, quite frankly,

02:16:20.160 --> 02:16:22.160
law enforcement had all they could

02:16:22.160 --> 02:16:24.160
do just to try to maintain

02:16:24.160 --> 02:16:26.160
order and move them along.

02:16:26.160 --> 02:16:28.160
I would have loved to have seen

02:16:28.160 --> 02:16:30.160
law enforcement write, you know,

02:16:30.160 --> 02:16:32.160
hundreds of citations.

02:16:32.160 --> 02:16:34.160
And, you know, that

02:16:34.160 --> 02:16:36.160
two prong approach there,

02:16:36.160 --> 02:16:38.160
but it wasn't feasible.

02:16:38.160 --> 02:16:40.160
So we trust the committee

02:16:40.160 --> 02:16:42.160
to do the heavy lifting

02:16:42.160 --> 02:16:44.160
to ask the serious questions

02:16:44.160 --> 02:16:46.160
to make the right decisions.

02:16:46.160 --> 02:16:48.160
This is kind of unusual that

02:16:48.160 --> 02:16:50.160
we are seeing

02:16:50.160 --> 02:16:54.160
an issue like this

02:16:54.160 --> 02:16:56.160
brought forth on the

02:16:56.160 --> 02:16:58.160
floor of the council

02:16:58.160 --> 02:17:00.160
for a

02:17:00.160 --> 02:17:02.160
um

02:17:02.160 --> 02:17:04.160
for action that

02:17:04.160 --> 02:17:06.160
is contrary to what the

02:17:06.160 --> 02:17:08.160
the committee saw.

02:17:08.160 --> 02:17:10.160
And it

02:17:10.160 --> 02:17:12.160
I did a quick glance

02:17:12.160 --> 02:17:14.160
and the fact that

02:17:14.160 --> 02:17:16.160
this bar appears to be a frequent

02:17:16.160 --> 02:17:18.160
flyer. This is not the first time

02:17:18.160 --> 02:17:20.160
they appeared. I looked at

02:17:20.160 --> 02:17:22.160
what happened and it doesn't appear

02:17:22.160 --> 02:17:24.160
that this is a situation

02:17:24.160 --> 02:17:28.160
where the patrons are

02:17:28.160 --> 02:17:30.160
necessarily driving

02:17:30.160 --> 02:17:32.160
the action

02:17:32.160 --> 02:17:34.160
in two cases. You had

02:17:34.160 --> 02:17:36.160
bartenders or

02:17:36.160 --> 02:17:38.160
staff that were

02:17:38.160 --> 02:17:40.160
representing law enforcement

02:17:40.160 --> 02:17:42.160
from coming in. That there were

02:17:42.160 --> 02:17:44.160
patrons in there. I don't know if

02:17:44.160 --> 02:17:46.160
it was after hours. I don't have

02:17:46.160 --> 02:17:48.160
that level of detail.

02:17:48.160 --> 02:17:50.160
But the fact that

02:17:50.160 --> 02:17:52.160
one, you have an unlicensed bartender

02:17:52.160 --> 02:17:54.160
and the owner has gone home,

02:17:54.160 --> 02:17:56.160
that's unacceptable.

02:17:56.160 --> 02:17:58.160
Two, you have the doors locked

02:17:58.160 --> 02:18:00.160
and you have patrons in there

02:18:00.160 --> 02:18:02.160
that's unacceptable.

02:18:02.160 --> 02:18:04.160
And I think the prudent action

02:18:04.160 --> 02:18:06.160
is to refer to

02:18:06.160 --> 02:18:08.160
for further action.

02:18:08.160 --> 02:18:10.160
And hopefully it's a wake-up call

02:18:10.160 --> 02:18:12.160
for the bar. I

02:18:12.160 --> 02:18:14.160
was a big advocate

02:18:14.160 --> 02:18:16.160
twenty years ago in

02:18:16.160 --> 02:18:18.160
negotiating settlements

02:18:18.160 --> 02:18:20.160
with taverns that were having

02:18:20.160 --> 02:18:22.160
problems coming up

02:18:22.160 --> 02:18:24.160
with a solution and

02:18:24.160 --> 02:18:26.160
holding them accountable

02:18:26.160 --> 02:18:28.160
for that to see if it

02:18:28.160 --> 02:18:30.160
helped. There was a bar in

02:18:30.160 --> 02:18:32.160
Alderman Widener's district, I

02:18:32.160 --> 02:18:34.160
believe, uh, Keckel Jax

02:18:34.160 --> 02:18:36.160
and we were

02:18:36.160 --> 02:18:38.160
coming pretty close to shutting

02:18:38.160 --> 02:18:40.160
them down and

02:18:40.160 --> 02:18:42.160
they, I think, got the message

02:18:42.160 --> 02:18:44.160
and implemented some

02:18:44.160 --> 02:18:46.160
things that prevented

02:18:46.160 --> 02:18:48.160
further problems like

02:18:48.160 --> 02:18:52.160
underage patrons,

02:18:52.160 --> 02:18:54.160
you know, through buying

02:18:54.160 --> 02:18:56.160
equipment that helped the

02:18:56.160 --> 02:18:58.160
process. So I support

02:18:58.160 --> 02:19:00.160
sending it to the city attorney's

02:19:00.160 --> 02:19:02.160
office. Thank you.

02:19:02.160 --> 02:19:06.160
Thank you. I will agree

02:19:06.160 --> 02:19:08.160
with Alderman Mack.

02:19:08.160 --> 02:19:10.160
It is unusual

02:19:10.160 --> 02:19:12.160
that the committee

02:19:12.160 --> 02:19:14.160
makes one decision and then

02:19:14.160 --> 02:19:16.160
we are asked to

02:19:16.160 --> 02:19:18.160
consider a different direction.

02:19:18.160 --> 02:19:20.160
I think, uh,

02:19:20.160 --> 02:19:22.160
also with

02:19:22.160 --> 02:19:24.160
Alderman Townsend,

02:19:24.160 --> 02:19:26.160
I'm sorry.

02:19:26.160 --> 02:19:28.160
I also agree with the consistency

02:19:28.160 --> 02:19:30.160
and the accountability piece.

02:19:30.160 --> 02:19:32.160
And I would like to

02:19:32.160 --> 02:19:34.160
see the committee

02:19:34.160 --> 02:19:36.160
work really

02:19:36.160 --> 02:19:38.160
intentionally

02:19:38.160 --> 02:19:40.160
to put together a

02:19:40.160 --> 02:19:42.160
relationship with the businesses

02:19:42.160 --> 02:19:44.160
and, um,

02:19:44.160 --> 02:19:46.160
design a, uh,

02:19:46.160 --> 02:19:48.160
a partnership

02:19:48.160 --> 02:19:50.160
of consistency about what

02:19:50.160 --> 02:19:52.160
the expectations are.

02:19:52.160 --> 02:19:54.160
How do they, uh,

02:19:54.160 --> 02:19:56.160
rise above

02:19:56.160 --> 02:19:58.160
what the patrons are

02:19:58.160 --> 02:20:00.160
possibly going to do,

02:20:00.160 --> 02:20:02.160
such as bring in weapons or,

02:20:02.160 --> 02:20:04.160
uh, you know, other things

02:20:04.160 --> 02:20:06.160
that patrons would do in that space

02:20:06.160 --> 02:20:08.160
that would be held accountable for.

02:20:08.160 --> 02:20:10.160
What about the policing that

02:20:10.160 --> 02:20:12.160
they're supposed to do or not do

02:20:12.160 --> 02:20:14.160
all the questions that they have

02:20:14.160 --> 02:20:16.160
and have had over the past

02:20:16.160 --> 02:20:18.160
years come up with something that

02:20:18.160 --> 02:20:20.160
does not change

02:20:20.160 --> 02:20:22.160
from one committee of one year

02:20:22.160 --> 02:20:24.160
to the next that can travel

02:20:24.160 --> 02:20:26.160
and then maybe also we

02:20:26.160 --> 02:20:28.160
consider what actual training

02:20:28.160 --> 02:20:30.160
looks like for

02:20:30.160 --> 02:20:32.160
that particular committee.

02:20:32.160 --> 02:20:34.160
I appreciate the

02:20:34.160 --> 02:20:36.160
attorney's definition

02:20:36.160 --> 02:20:38.160
of what would happen going for.

02:20:38.160 --> 02:20:42.160
So, as Alderman Frazier said,

02:20:42.160 --> 02:20:44.160
being able to support

02:20:44.160 --> 02:20:46.160
the businesses and what they want

02:20:46.160 --> 02:20:48.160
to be able to accomplish down in

02:20:48.160 --> 02:20:50.160
his district is important.

02:20:50.160 --> 02:20:52.160
I would like to think that we are

02:20:52.160 --> 02:20:54.160
not going to put the foot on the

02:20:54.160 --> 02:20:56.160
desk and just say that

02:20:56.160 --> 02:20:58.160
they have to close right now

02:20:58.160 --> 02:21:00.160
that they're going to lose their

02:21:00.160 --> 02:21:02.160
license, that we would put in

02:21:02.160 --> 02:21:04.160
place some directives that

02:21:04.160 --> 02:21:06.160
they would have to respond to

02:21:06.160 --> 02:21:08.160
and then see how we hold them

02:21:08.160 --> 02:21:09.160
accountable to deeds at

02:21:09.160 --> 02:21:10.160
our probationary time.

02:21:10.160 --> 02:21:12.160
And then that would also

02:21:12.160 --> 02:21:14.160
coincide with the initiative

02:21:14.160 --> 02:21:16.160
of the committee to start

02:21:16.160 --> 02:21:18.160
working on that list of

02:21:18.160 --> 02:21:20.160
requirements and requisites

02:21:20.160 --> 02:21:22.160
that all of the businesses

02:21:22.160 --> 02:21:24.160
would need to respond to

02:21:24.160 --> 02:21:26.160
and then bring that information

02:21:26.160 --> 02:21:28.160
to the full committee.

02:21:28.160 --> 02:21:30.160
Alderman?

02:21:30.160 --> 02:21:32.160
Thank you, Mr.

02:21:32.160 --> 02:21:34.160
I too would be in support of

02:21:34.160 --> 02:21:36.160
this going forward.

02:21:36.160 --> 02:21:38.160
Public safety is important.

02:21:38.160 --> 02:21:40.160
We've had multiple

02:21:40.160 --> 02:21:42.160
shootings throughout the city.

02:21:42.160 --> 02:21:44.160
We've had people shot and

02:21:44.160 --> 02:21:46.160
people killed in the city and

02:21:46.160 --> 02:21:48.160
they have not all been violated

02:21:48.160 --> 02:21:50.160
but some have.

02:21:50.160 --> 02:21:52.160
And so I think that this would

02:21:52.160 --> 02:21:54.160
not be the first bar that

02:21:54.160 --> 02:21:56.160
has to go through this process.

02:21:56.160 --> 02:21:58.160
I also set on PSL

02:21:58.160 --> 02:22:00.160
for about three years myself

02:22:00.160 --> 02:22:02.160
and there were a time that we

02:22:02.160 --> 02:22:04.160
had a bar on Douglas that had

02:22:04.160 --> 02:22:06.160
200 people taking over the street

02:22:06.160 --> 02:22:08.160
in Douglas and we had the

02:22:08.160 --> 02:22:10.160
entire force out there to make

02:22:10.160 --> 02:22:12.160
sure that everybody was

02:22:12.160 --> 02:22:14.160
out of the street and everybody

02:22:14.160 --> 02:22:16.160
got home safe.

02:22:16.160 --> 02:22:18.160
The other part of it is that

02:22:18.160 --> 02:22:20.160
once we got to this process

02:22:20.160 --> 02:22:22.160
the owner themselves said

02:22:22.160 --> 02:22:24.160
hey, we're going to close for

02:22:24.160 --> 02:22:26.160
60 days and he was working

02:22:26.160 --> 02:22:28.160
directly with the chief.

02:22:28.160 --> 02:22:30.160
And so basically, you know,

02:22:30.160 --> 02:22:32.160
this is just a wake-up call and

02:22:32.160 --> 02:22:34.160
not saying that this bar will

02:22:34.160 --> 02:22:36.160
close or the license will be

02:22:36.160 --> 02:22:38.160
taken but it's just the

02:22:38.160 --> 02:22:40.160
procedures that's going to

02:22:40.160 --> 02:22:42.160
put in place for the

02:22:42.160 --> 02:22:44.160
owner to be successful.

02:22:44.160 --> 02:22:46.160
Thank you.

02:22:46.160 --> 02:22:48.160
I would like to ask the city

02:22:48.160 --> 02:22:50.160
attorney to restate the motion

02:22:50.160 --> 02:22:52.160
before we go to a vote.

02:22:52.160 --> 02:22:54.160
The motion was to refer the

02:22:54.160 --> 02:22:56.160
licensee to the city

02:22:56.160 --> 02:22:58.160
attorney's office for consideration

02:22:58.160 --> 02:23:00.160
of further disciplinary

02:23:00.160 --> 02:23:02.160
proceedings as contemplated

02:23:02.160 --> 02:23:04.160
by Racina Ordinance.

02:23:04.160 --> 02:23:06.160
When the clerk calls your

02:23:06.160 --> 02:23:08.160
name, please vote

02:23:08.160 --> 02:23:10.160
as you wish.

02:23:10.160 --> 02:23:12.160
Thank you.

02:23:12.160 --> 02:23:14.160
Aye.

02:23:14.160 --> 02:23:16.160
Aye.

02:23:16.160 --> 02:23:18.160
Aye.

02:23:18.160 --> 02:23:19.160
Aye.

02:23:19.160 --> 02:23:20.160
Aye.

02:23:20.160 --> 02:23:21.160
Aye.

any other items for separate

02:23:45.160 --> 02:23:46.160
consideration?

02:23:47.160 --> 02:23:48.160
Then without objections,

02:23:48.160 --> 02:23:49.160
the remainer of this report will

02:23:49.160 --> 02:23:51.160
be placed on the consent agenda.

Then without Objections, do you

02:23:55.160 --> 02:23:56.160
have any requests

02:23:56.160 --> 02:23:57.160
for several considerations on

02:23:57.160 --> 02:23:58.160
these appointments?

02:23:58.160 --> 02:24:00.160
I did not have them.

02:24:00.160 --> 02:24:01.160

02:24:01.160 --> 02:24:03.160
items will be placed on the

02:24:03.160 --> 02:24:04.160

We are on to announcements all to promote.

02:24:23.480 --> 02:24:30.520
Thank you Mr. Mayor. I just want to say thank you to my colleagues and also to a lot of my

02:24:30.520 --> 02:24:34.760
constituents members of the city that reached out during this time, difficult time for my

02:24:34.760 --> 02:24:40.360
family RPD. I mean just everything has been really supportive so I really appreciate that.

02:24:41.000 --> 02:24:45.240
Also I said at the last council meeting we have a ton of July birthies and my family

02:24:45.240 --> 02:24:48.760
I'm not going to rehash that they got their moment in the spotlight so it'll be fine.

02:24:48.760 --> 02:24:53.400
But I do want to say we had a chance to visit Sam and Aramah one of their days and it was

02:24:53.400 --> 02:24:58.120
fantastic. My nieces had a lot of fun. My wife and I we got to tour the veterans outreach had

02:24:58.120 --> 02:25:03.160
one of their veterans tiny homes there so it was really interesting to see and they had a lot

02:25:03.240 --> 02:25:08.600
of great raffles and vendors just a lot of really great stuff also that kind of goes hand in hand

02:25:08.600 --> 02:25:13.800
with the farmers market that's down there still going strong doing really great things if you

02:25:13.800 --> 02:25:21.720
haven't been please stop by and then Sam and Will's on three mile and Douglas at the intersection

02:25:21.720 --> 02:25:26.040
there we we had a chance to go there great food great staff great service they're just doing

02:25:26.040 --> 02:25:31.080
really well on that side so kudos to them pretty thank you aller to mark

02:25:33.480 --> 02:25:40.680
I just want to remind everyone that I hope everyone could come out to Italian fast at Romelage

02:25:42.520 --> 02:25:49.160
and usually it's a good time out there. The other thing is the recent news that just came out

02:25:49.960 --> 02:25:59.880
about the recent suicide over by the lake there's been a lot of issues with mental health across

02:25:59.880 --> 02:26:07.560
the country not only in the city we're seeing and if you ever feel like you are

02:26:09.640 --> 02:26:14.200
just anyone who's watching if you ever feel like you're down if you ever feel like you're in that

02:26:14.360 --> 02:26:23.720
road there is help all you got to do is just dial 988 that's the hotline and they're really helpful

02:26:26.360 --> 02:26:32.280
thank you aller to mark aller mac thank you I need to give a shout out to my wife

02:26:33.800 --> 02:26:41.800
her brother has ALS and for the almost the last year she's been helping to take care of him on

02:26:42.520 --> 02:26:50.040
Saturday and Sundays goes over there helps put him to bed it's a five six hour process

02:26:50.760 --> 02:27:00.760
and so she decided that she was going to take a CNA class to just help gain some skills as she's

02:27:01.800 --> 02:27:09.240
helping him so I'd like to congratulate her on completing the class passing her first

02:27:09.720 --> 02:27:17.080
step in getting state certification in this Friday she goes for her final

02:27:18.360 --> 02:27:27.400
practical exam or whatever it is for state licensing so give a shout out to her for taking

02:27:27.960 --> 02:27:33.960
that initiative and I guess it means that when I reach that point of needing help she'll

02:27:34.680 --> 02:27:41.160
be able to help me so I'm getting older you know so anyway congratulations Amy

02:27:42.680 --> 02:27:49.720
all around thank you first I'm going to publicly apologize to all their davis I'm so sorry to

02:30:24.040 --> 02:30:28.680
funded it is one of a few places in the country where students are actually paid as a summer job

02:30:28.680 --> 02:30:33.080
to create art over the summer so it's a a long-standing tradition that we've had in this

02:30:33.080 --> 02:30:37.560
community and it's a really great program I'd encourage everyone to take it to the to the art

02:30:37.560 --> 02:30:43.480
show it's a it's a great event I'll do Mac for a second time my apologies I've never done this
